Title: Power to Require Closing of Burial or Burning Ground

.....shall be annexed to the notice. Title: Power to Require Closing of Burial or Burning Ground

.....of, persons living in the neighbourhood, it may with the previous sanction of the Central Government by notice in writing, require the owner or person in charge of such ground to close the same from such date as may be specified in the notice. (2) Where the Central Government sanctions the issue of any notice under subsection (1) it shall declare the conditions on which the burial or burning ground may be reopened, and a copy of such declaration shall be annexed to the notice. (3) Where the Central Government sanctions the issues of any such notice, it shall require a new burial or burning ground to be provided at the expense of the cantonment fund, or, if the community concerned is willing to provide a new burial or burning ground, the Central Government shall require a grant to be made from the cantonment fund towards the cost of the same. (4) No corpse shall be buried or burnt in any burial or burning ground in respect of which a notice issued under this section is for the time being in force.

Karnataka Municipal Corporations Act, 1976 Section 397

Title: Prohibition Against Use of Burial and Burning Grounds Dangerous to Health or Overcrowded with Graves

State: Karnataka

Year: 1976

(1) If the Commissioner is of opinion,- (a) that any registered or licensed place for the disposal of the dead or any place provided for such disposal by the Corporation or by the Government is in such a state or situation as to or to be likely to become dangerous to health of persons living in the neighbourhood thereof; or (b) that any burial ground is overcrowded with graves, and if in the case of a public or burning ground or other place as aforesaid another convenient place duly authorised for the disposal of the dead exists or has been provided for the persons who would ordinarily make use of such place, he may with the consent of the corporation and the previous sanction of the Government, give notice that it shall not be lawful after a period to be named in such notice, to bury, burn or otherwise dispose of any corpse at such place. (2) Every notice given under sub-section (1) shall be affixed to some part of such place. (3) After the expiry of the period named in such notice it shall not be lawful to bury, burn or otherwise dispose of a corpse at such place except with the permission of the Commissioner.

Karnataka Municipal Corporations Act, 1976 Section 393

Title: Provision of Places by the Corporation for Burial and Burning Grounds and Crematoria

State: Karnataka

Year: 1976

(1) The corporation may, and shall if no sufficient provision exists, provide places to be used as burial or burning grounds or crematoria, either within, or with the sanction of the Government outside the limits of the city; and may charge and levy rents and fees for the use thereof: Provided that the corporation shall itself undertake the cremation of unclaimed dead bodies free of charge. (2) If the corporation provides any such place without the limits of the corporation all the provisions of this Act and all bye-laws framed under this Act for the management of such places within the corporation shall apply to such place and all offences against such provisions or bye-laws shall be congnizable by a magistrate as if such places were within the corporation limits.

Title: Powers in Respect of Burial and Burning Places

.....no suitable place for burial or burning exists within a reasonable distance, provide a filling place for the purpose. (3) If any person, without the permission of the municipality bury or burn any corpse, or permit, to be buried or burnt, any corpse at any place which is not any burial or burning ground made or formed according to the provisions of this section, or after the date fixed thereunder for closing the same, he shall be punishable with fine which may extend to five hundred rupees. (4) Private burial places may be exempted from the order subject to such conditions as the municipality may impose in this behalf: Provided that the limits of such burial places are sufficiently defined and that they shall only be used for the burial of members of the family of the owners thereof. (5) No private burial or burning ground shall be made or formed within the municipality after the commencement of this Act, without the permission in writing of the municipality.

Karnataka Panchayat Raj Act, 1993 Section 92

Title: Registration of Burial and Burning Grounds

State: Karnataka

Year: 1993

(1) Every owner or person having the control of any place used at the commencement of this Act, as a public place for burying, burning or otherwise disposing of the dead in a panchayat area, shall, if such place be not already registered under any law applicable thereto, apply to the Grama Panchayat to have such place registered under this Act. (2) If it appears to such Grama Panchayat that there is no owner or person having control of such place, the Grama Panchayat shall assume such control, and register such place or may close it.
