Title: Prohibition of Performance of Dance in Eating House, Permit Room or Beer Bar and Other Consequential Provisions

1[(1) Notwithstanding anything contained in this Act or the rules made by the Commissioner of Police or the District Magistrate under sub-section (1) of section 33 for the area under their respective charges, on and from the date of commencement of the Bombay Police (Amendment) Act, 2005,-- 1. Sections 33A, 33B were inserted by the Bombay Police (Amendment) Act, 2005. Mah. 35 of 2005 (w.e.f. 14-8-2005). (a) holding of a performance of dance, of any kind or type, in an eating house, permit room or beer bar is prohibited; (b) all performance licences, issued under the aforesaid rules by the Commissioner of Police or the District Magistrate or any other officer, as the case may be, being the Licensing Authority, to hold a dance performance, of any kind or type, in an eating house, permit room or beer bar shall stand cancelled. (2) Notwithstanding anything contained in section 131, any person who holds or causes or permits to be held a dance performance of any kind or type, in an eating house, permit room or beer bar in contravention of sub-section (1), shall on conviction, be punished with imprisonment for a term which may extend to three years or with fine which may extend.....

Title: House Breaking

.....means by which that passage was not intended by the occupier of the house to be opened. Fourthly.--If he enters or quits by opening any lock in order to the committing of the house-trespass, or in order 10 the quitting of the house after a house-trespass. Fifthly.--If he effects his entrance or departure by using criminal force or committing an assault or by threatening any person with assault. Sixthly.--If he enters or quits by any passage which he knows to have been fastened against such entrance or departure, and to have been unfastened by himself or by an abettor of the house-trespass. Explanation.--Any out-house or building occupied with a house, and between which and such house there is an immediate internal communication, is part of the house within the meaning of this section. Illustrations (a) A commits house-trespass by making a hole through the wall of Z's house, and putting his hand through the aperture. This is house-breaking. (b) A commits house-trespass by creeping into a ship at a port-hole between decks. This is house-breaking. (c) A commits house-trespass by entering Z's house through a window. This is house-breaking. Title: Provision as to the Opening and Breaking Up of Streets, Railways and Tramways

Indian Penal Code (45 of 1860) Section 457

Title: Lurking House-trespass or House-breaking by Night in Order to Commit Offence Punishable with Imprisonment

.....court may, for adequate and special reasons to be me ntioned in the judgment, impose a sentence of imprisonment for a term of less than three years". 2[ State of Uttar Pradesh Amendment of section 457 - section 457 of the principal Act shall be renumbered as sub­section (I) of that section and after sub section ( 1 ) as so renumbered, the following sub-section shall be added namely-- ( 2 ) Whoever commits lurking house trespass by night or house breaking by night in any building used as a place of worship in order to the committing of the offence of theft of any idol or icon from such buildings shall notwithstanding any thing contained in sub-section ( 1 ) be punished with rigorous imprisonment which shall not be less than three years but which may extend to fourteen years and with fine which shall not be less than five thousand rupees: Provided that the court may, for adequate and special reasons to be me ntioned in the judgment, impose a sentence of imprisonment for a term of less than three years. _________________ 1. Oriental Gas Company Act ,1857 Section 1

Title: Power to Break Up Streets, Etc., Under Superintendence, and to Open Drains

In the Town of Calcutta and its environs and in any other town or place to which the provisions of this Act may hereafter be extended, by a law to be passed for that purpose the Oriental Gas Company Limited under such superintendence as is hereinafter specified may open and break up the soil and pavement of the several streets and bridges and may open and break up any sewers drains or tunnels within or under such streets and bridges and lay down and place within the same limits pipes conduits service pipes and other works and from time repair alter or remove the same and also make any sewers that may be necessary for carrying off the washings and waste liquids which may arise in the making of the Gas and for the purposes aforesaid may remove and use all earth and materials inland under such streets and bridges and they may in such streets erect any pillars lamps and other works and do all other acts which the said Company shall from time to time deem necessary for supplying Gas to the inhabitants of the said Town of Calcutta and its environs or other town or place as aforesaid doing as title damage as may be in the execution of the powers hereby granted and making compensation.....

Oriental Gas Company Act ,1857 Section 3

Title: Notice to Be Served on Persons Having Control, Etc., Before Breaking Up Streets or Opening Drains

Before the said Company proceed to open or break up any street, bridges, sewer, drain.or tunnel shall given to the municipal Commissioners for the Town of Calcutta, or Other persons under whose control or management the same may be or to other persons under whose control to management the same may be or to their Clerk, Surveyor, or other officer notice in writing of their intention or open or break up the clear days before beginning such work ; except in cases of emergency arising from defects in any of the pipes or other works, and then so soon as is possible after the beginning of the work or the necessity for the same shall have arisen.

Title: All Persons Jointly Concerned in Lurking House-trespass or House-breaking by Night Punishable Where Death or Grievous Hurt Caused by One of Them

If, at the time of the committing of lurking house-1 res pass by night or house-breaking by night, any person guilty of such offence shall voluntarily cause or attempt to cause death or grievous hurt to any person, every person jointly concerned in committing such lurking house-trespass by night or house-breaking by night, shall be punished with1[imprisonment for life], or with imprisonment of either description for a term which may extend to ten years, and shall also be liable to fine. ________________________ 1.
