BENGAL BONDED WAREHOUSE ASSOCIATION 1854 [Act, No. 5 of 1854] [AS ON 1958] [10th February, 1854] Preamble An, Act to amend Act No.V of I838, relating to the Bengal bonded Warehouse Association. WHEREAS the Bengal Bonded Warehouse Association are desirous that the provisions of Act No.V of 1838 should be amended, and it appears reasonable that such amendment should be made, it is enacted as follows:-

Bengal Bonded Warehouse Association, 1854 Complete Act

.....that purpose, provided also that no such Bye-law shall be valid till it shall have been confirmed by the Substituted by the A.O.1937, for "Governor of the Presidency of Fort William in Bengal. Section 7 Dissolution of Corporation Section At any time after the 14th day of March, 1860, it shall be lawful for the Central Government by an order in Council to direct that the said Association shall be dissolved at the expiration of five years from the date of such order, and such order shall of itself have the effect of dissolving the said Corporation at the expiration of the said space of five years, except for the purposes mentioned in section 39, Act No.V of 1838. It is hereby enacted, that the persons whose names appear in the Schedule No. 1, hereunto annexed, shall, from the 14th day of March, 1838, form a corporate body for the Warehousing of Goods, either in bond or otherwise, by the name of the Bengal Bonded Warehouse Association.

.....or, to determine the capacity of any cask or receptacle; (xii) "laboratory" means that part of a non-bonded or bonded manufactory in which the actual manufacture of dutiable goods takes place; (xiii) "manufacturer" means a person to whom a licence has been granted for the manufacture of dutiable goods; (xiv) "officer-in-charge" means an officer of the Excise Department of any State appointed by the collecting Government to supervise work in a bonded manufactory or a bonded warehouse and includes officers of any other Department similarly appointed; (xv) "proper officer" means an Excise Officer in whose jurisdiction the premises of the manufacturer of any dutiable goods, or of any person engaged in the process of manufacture of,or trade in such goods or containers thereof, whether as manufacturer, wholesale dealer, or intended manufacturer or wholesale dealer, are situated; (xvi) "prove" means to test the strength of alcohol by hydrometer or other suitable instrument; (xvii) "quarter" means a period of three months beginning with 1st January, 1st April, 1st July or 1st October; (xviii) "rectified spirit" means plain undenatured alcohol of a strength not less than 50.0.....

.....that labelling of bottles or unit packages, in ported into India or into Delhi, to comply with statutory requirements shall not be construed as manufacture; (50) "manufacturer" mean any person who manufactures intoxicants and includes a manufacturer of alcohol subject to excise duty under the Central Excise Act, 1944 (1 of 1944); (51) "molasses" means heavy viscous liquid produced, in the final stage of manufacture of gur or sugar including khandsari, sugar from sugar cane or gur, when liquid as such or in any form or ad-mixture containing sugar which can be fermented; (52) "MRP" means the maximum price at which the liquor may be sold to the ultimate consumer and shall include all taxes, freight, transport charges, commission or trade margin payable to dealers, and all charges towards marketing, delivery, packing, forwarding and the like as the case may be; (53) "notification' means a notification issued under this Act and the rules framed thereunder and published in the official Gazette; (54) "officer-in-charge" means the excise officer authorized to supervise and control manufactory or warehouse; (55) "pachwai" means fermented rice, millet or other grain, and.....
