.....taken upon the result of such inspection or inquiry. : (9) Where the Executive Council or the management does not, within a reasonable time, take action to the satisfaction of the Visitor, the Visitor may. after considering any explanation furnished or representation made by the Executive Council or management, issue such directions as he may think fit and the Executive Council or management, as the case may be, shall comply with such directions. .....Short title and extent (1) This Act may be called the Departmental Proceedings (Enforcement of Attendance of Witnesses and Production of Documents) Act, 1973. Section 2 Departmental proceedings to which the Act shall apply The provisions of this Act shall apply to every departmental proceedings made in relation to (a) persons appointed to public services or posts in connection with affairs of the State; (b) persons who, having been appointed to any public service or post in connection with the affairs of the State, are in service or pay of- (i) any local authority, (ii) any corporation owned or controlled by the State Government, (iii) any Government company within the meaning of section 617 of the Companies Act, 1956, in which not less than fifty-one per cent. of the paid-up share capital is held by the State Government or any company which is a subsidiary of such Government company, (iv) any society registered under the West Bengal Societies Registration Act, 1961, which is subject to the control of the State Government. (1) The State Government may, by notification and subject to the condition of previous publication, make rules to carry out the purposes of this Act. (2) In particular and without prejudice to the generality of the foregoing provision, such rules may provide for, - (a) all matters expressly required or allowed by this Act to be prescribed. (b) the procedure to be followed by the Deputy Commissioner and the officers or authorities appointed or having jurisdiction under this Act; (c) the time within which applications and appeals may be presented under this Act, in cases for which no specific provision in that behalf is made herein; (d) the application of the provisions of the Code of Civil Procedure, 1908 and the Limitation Act, 1963 to applications, appeals and proceedings, under this Act.
