.....to have come into force on the 15th day of November, 1998. 2. Definitions - In this Act, unless the context otherwise requires,- (a) "action" means any action including administrative action taken by way of decision, recommendation or finding or in any other manner and includes wilful failure or omission to act and all other expressions relating to such action shall be construed accordingly; (b) "allegation", in relation to a public servant, means any affirmation that such public servant,- (i) has abused his position as such public servant to obtain any gain or favour to himself or to any other person or to cause undue harm or hardship to any other person; (ii) was actuated in the discharge of his functions as such public servant by persosnal interest or improper or corrupt motives; or (iii) is guilty of corruption, favouritism, nepotism or lack of integrity in his capacity as such public servant; (c) "Chief Minister" means the Chief Minister of the State; (d) "competent authority", in relation to a public servant, means- (i) in the case of the Chief Minister or a Member of the State Legislature, or an.....

Be it enacted by Parliament in the Fiftieth Year of the Republic of India as follows: STATEMENT OF OBJECTS AND REASONS 1. The insurance industry requires a high degree of regulation. The Insurance Act, 1938 provides for the institution of the Controller of Insurance to act as a strong and powerful supervisory and regulatory authority with powers to direct, advise, caution, prohibit, investigate, inspect, prosecute, search, seize, fine, amalgamate, authorise, register and liquidate insurance companies. However, after the nationalisation of the life insurance industry in 1956 and the general insurance industry in 1972, the role of the Controller of Insurance diminished in significance over a period of time. 2. In April, 1993, the Government set up a high-powered Committee headed by Shri R.N. Malhotra, former Governor, Reserve Bank of India, to examine the structure of the insurance industry and recommend changes to make it more efficient and competitive keeping in view the structural changes in other parts of the financial.....

(1) No suit, prosecution or other legal proceeding shall lie against any public servant or person appointed or authorised under this Act in respect of anything done or intended to be done in good faith under this Act or in pursuance of any order made or directions issued under this Act. (2) No suit, prosecution or other legal proceeding shall lie against the Government or any Officer of the Government for any damage caused or likely be caused by anything done or intended to be done in good faith under this Act or in pursuance of any order made or direction issued under this Act.
