Notwithstanding anything contained in the Code of Criminal Procedure, 1973, any police officer not below the rank of Sub-Inspector of Police may arrest without warrant any person who is reasonably suspected of having committed any such offence. Appeal - (1 ) Any person aggrieved by an order of confiscation made under Section 7 may within one month from the date of communication to him of such order, appeal to the [Substituted vide O.A. No. 662, Dt. 29.5.1997.] [Director, Transmission and Distribution of the Gridco] and the appellate authority after giving an opportunity to the appellant to be heard, may pass such order as he may think fit, confirming, modifying, or annulling the order appealed against. (2) The appellate order shall be final and notwithstanding the result of the criminal case, if any, the confiscation as confirmed by the appellate authority shall not be questioned in any Civil or Criminal Court of Law. 9. (1) This Act may be called the Orissa Municipal Councils (Postponement of Elections) Amendment Act, 1988. (2) It shall be deemed to have come into force on the 31st day of December, 1987. Amendment of section-3 Orissa Act 9 of 1984 2. In clause (b) of section 3 of the Orissa Municipal Councils (Postponement of Elections) Act, 1984 (hereinafter referred to as the principal Act), for the words, figures and letters "the 31st December, 1987" the word, figures and letters "the 31st December, 1988" shall be substituted. Repeal and savings. Orissa Ordinance No. 4 of 1987. 3. (1 ) The Orissa Municipal Councils (Postponement of Elections) Amendment) Ordinance, 1987 is hereby repealed. (2) Notwithstanding such repeal, anything done or any action taken under the principal Act, as amended by the said Ordinance shall be deemed to have been done or taken under the principal Act as amended by this Act. Amendment of section 13. 3. In the principal Act, in sub-section (1) of section 13, for the words "July of the succeeding financial year", the words "April of the succeeding calendar year" shall be substituted. Amendment of section 14 and 15. 4. In the principal Act, in clauses (e) and (f) of section 14 and clauses (a) and (e) of section 15, for the words "Tribal and Rural Welfare", the words "Harijan and Tribal Welfare" shall be substituted. No. 11 of 1988.] PREAMBLE An Act to amend the Code of Criminal Procedure, 1973 in its application to the State of Orissa Be it enacted by the Legislature of the State of Orissa in the Thirty-ninth Year of the Republic of India, as follows : Section 1 - Short title This Act may be called the Code of Criminal Procedure (Orissa Amendment) Act, 1988. Section 2 - Section 2 Amendment of Section 438-In Section 438 of the Code of Criminal Procedure, 1973, to Sub-section (1), the following proviso shall be added, namely: "Provided that where the apprehended accusation relates to an offence punishable with death, imprisonment for life or imprisonment for a term of not less than seven years, no final order shall be made on such application without giving the State notice to present its case."
