THE ORISSA RE-ENACTING ACT, 1974 THE ORISSA RE-ENACTING ACT, 1974 [For the Statement of Objects and Reasons see Orissa Gazette, Extraordinary, dated the 10th December, 1974 (No. 1935).] ORISSA ACT 13 OF 1975 [Received the assent of the President on the 26th February 1975, first published in an extraordinary issue of the Orissa Gazette, dated the 1st March 1975] AN ACT TO RE-ENACT CERTAIN ENACTMENTS WHEREAS the President of India, by a Proclamation issued on the 3rd March, 1973 under Article 356 of the Constitution, assumed to himself all functions of the State Government and declared that the powers of the State Legislature shall be exercisable by or under the authority of Parliament; AND WHEREAS in pursuance of those powers certain laws have been made by the President; AND WHEREAS the said Proclamation was revoked by the President on the 6th March, 1974; AND WHEREAS clause (2) of Article 357 of the Constitution provides that the laws so made by the President which the President would not, but for the issue of the Proclamation have been competent to make, shall, to the extent of the incompetency, cease to have effect on the expiration of a period of one.....
List Judgments citing this section.....of the said Schedule. The bill seeks to achieve the above purpose. Section 1 - Short title This Act may be called the Court-fees (Orissa Amendment) Act, 1974. Section 2 - Amendment of Schedule II In Schedule II to the Court-fees Act, 1980( Act 7 of 1870). (a) in Article 1, the entries occurring under the heading "proper fee" as mentioned in Column (1) of the following Schedule shall respectively be substituted by the entries shown against them in Column (2) thereof: SCHEDULE Entries occurring under the heading "Proper fee" (1) Entries to be substituted (2) 1. Ten naye paise Thirty paise. 2. In the case of a criminal complaint and appeal, one rupee and in other cases seventy-five naye paise. In the case of a criminal complaint and appeal, one rupee and fifty paise and in other cases eighty paise. 3. One rupee and fifty naye paise One rupee and sixty-five paise. 4. Five rupees Five rupees and fifty paise. 5. Ten rupees Eleven rupees. 6. Two rupees Two rupees and twenty paise. (b) in Article 1-A, for the words "one rupee", the words "one rupee and ten paise" shall be substituted; (c) in Article 2,.....

(3) All persons who are to take part at any such election by virtue of holding office as members of any of the said authorities shall, notwithstanding the fact that they have not assumed such office, be eligible to take such part.] 11. Repeal and savings . (1) The Utkal University (Taking Over of Management) Ordinance, 1974 and the Utkal Univer sity (Taking Over of Management) (Amendment) Ordinance, 1974 are hereby repealed. (2) Notwithstanding such repeal, any order notified, any direction given, anything done or any action taken under the Ordinances so repealed shall be deemed to have been notified, given done or taken under the corresponding provisions of this Act.
