(1) If any member dies, or ceases to a member as provided in section 10, the President shall forthwith report the fact of the vacancy to the of State Government and the vacancy shall be filled as soon as possible, by a fresh election or nomina tion, as the case may be, under sub-section (1) of section 4. Members of the Home Guards acting under this Act shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code. 12. Notwithstanding anything to the contrary contained in any other law for the time being in force a member of the Home Guards shall not be disquali fied for being chosen as or for being, a member of the Orissa Legislative Assembly or of any local authority merely by reason of the fact that he is a bodies member of the Home Guards.
