[Minister of State] or Deputy Minister for the Union or for any State, whether ex officio or by name; (b) the office of the Speaker or the Deputy Speaker of the Orissa Legislative Assembly or of Parliament and Legislative Assembly of any other State; (c) the office of the Chief Whip, Deputy Chief Whip or Whip in any Legislative Assembly or in Parliament or the Office of a Parliamentary Secretary; (d) the office of a member of any force raised or maintained under the National Cadet Corps Act, 1948, the Territorial Army Act, 1948, or the Reserve and Auxiliary Air Forces Act, 1952; (e) the office of a member of a Home Guard constituted under any law for the time being in force in any State; (f) the office of Chairman or member of the Syndicate, Senate, executive committee, council or court of a University or any other body connected with a University; (g) the office of a member of any delegation or mission sent outside India by the Govern ment of India or of any State or sent outside-the.....

(1) If any member dies, or ceases to a member as provided in section 10, the President shall forthwith report the fact of the vacancy to the of State Government and the vacancy shall be filled as soon as possible, by a fresh election or nomina tion, as the case may be, under sub-section (1) of section 4. (2) The person so elected, or nominated shall hold office for the unexpired remainder of the term for which such member would otherwise have continued in office. .....as follows:- Short title, extent and commencement. 1 . (1) This Act may be called the Orissa Sales Tax Validation Act, 1961. (2) It extends to the whole of the State of Orissa. (3) It shall come into force at once. Validation of certain assessment under the Orissa Sales Tax Act, 1947. 2. Notwithstanding anything contained in any judgment, decree or order of any court, the word "manufacturer" occurring against item 33 in the Schedule to the notification of the Government of Orissa in the Finance Department No. 5602-F., dated the 28th July 1947 as amended by notification of the Government of Orissa in the Finance Department No. 8728-F,. dated the 1st July 1949 shall mean and shall always be deemed to have meant a person who by his own labour works up materials into suitable forms and a person who owns or runs a manufactory for the purpose of business with respect to the articles manufactured therein. .....Goshala recorded in the register of Goshalas, the trustee of such Goshala shall, within three months of the occurrence of such change, report the fact to the Registrar and every such report shall be signed by every trustee or by his agent specially authorised in this behalf and the person signing such report shall verify it in the prescribed manner. (2) The Registrar may after making such inquiry as he may deem fit, amend the register if he considers it necessarily and shall forward copies of the amended entry of the register to the Director and to the Federa tion. Members of the Home Guards acting under this Act shall be deemed to be public servants within the meaning of section 21 of the Indian Penal Code. 12. Home Guards not disqualified from contesting elections to State Legislature or local bodies. Notwithstanding anything to the contrary contained in any other law for the time being in force a member of the Home Guards shall not be disquali fied for being chosen as or for being, a member of the Orissa Legislative Assembly or of any local authority merely by reason of the fact that he is a bodies member of the Home Guards. If any difficulty arises in giving effect to the provisions of this Act, the State Government may, as the occasion may require, do anything which appears to them necessary for the purpose of removing the difficulty.
