The Orissa Estates Abolition Act, 1951 Complete Act

.....Homesteads of Intermediaries and buildings together with lands on which such buildings stand in the possession of intermediaries and used as golas, factories or mills to be retained by them on payment of rent " (1) With effect from the date of vesting, all homesteads comprised in an estate and being in the possession of an Intermediary on the date of such vesting, such buildings or structures together with the lands on which they stand, other than any buildings used primarily as offices or kutcheries or rest houses for estate servants on duty as were in the possession of an Intermediary at the commencement of this Act and used as golas (other than golas used primarily for storing rent in kind) factories or mills for the purpose of trade, manufacture or commerce, or used for storing grains or keeping cattle or implements for the aforesaid purposes before the 1st day of January, 1946, shall notwithstanding anything contained in this Act, be deemed to be settled by the State Government with such Intermediary and with all the share-holders owning the estate, who shall be entitled to retain possession of such homesteads and of such buildings or structures together with the lands on.....

.....of the lease beyond five years shall, for the purposes of this sub-section, be deemed to be a lease for a term exceeding five years. (1 -a) The fact of execution of a lease deed with a condition for renewal or renewal of such a deed shall be communicated to the Commissioner by the Trustee not later than fifteen days from the date of execution. (1-b) After expiry of the term of the lease the lessee shall deliver possession of the leasehold land to the lessor, failing which, the Commissioner may take action in accordance with the provision of Section 68 : Provided that all structures, permanent or temporary, if any, constructed plants and machineries and other things installed and kept on the leasehold land, which is a subject-matter of a lease executed after commencement of the Orissa Hindu Religious Endowments (Amendment) Act 22 of 1989 by the lessee, his servants or agents, shall become the property of the religious institution unless removed from the land within such period, as may be prescribed, after expiry of the term of lease, in respect of which the Commissioner shall take action under the provision of Section 68. .....the powers of a Board of Revenue in respect of his charge, the functioning of two independent officers as Board of Revenue did not work very satisfactorily and the necessity for a Board of Revenue for the entire State of Orissa was keenly felt. The Bill therefore seeks to create a Board of Revenue with three members. With the creation of the Board the Revenue Commissioner, the Commissioner, Northern Division and the Commissioner of Excise will be abolished and their functions will be taken over by the Board. The functions of the Food Commissioner will be discharged by a member of the Board. The post of Food Commissioner will not be filled up. 2. The creation of the Board will be administered conveniently as it will cut out the stages of reference between the district offices and the Government. Henceforth the Board will take orders from Government and communicate them to the district offices This will ensure quicker transaction of business, effecting economy in expenditure at the same time as tour offices, namely, those of the Revenue Commissioner of Excise and the Revenue Department of Government will be condensed into one. .....to amend the Orissa Court-fees (Surcharge Amendment) Act, 1947 Whereas it is expedient further to amend the Orissa Court-fees, (Surcharge Amendment) Act, 1947 (Orissa Act XX of 1947) in the manner hereinafter appearing: It is hereby enacted as follows: Section 1 - Short title and commencement (1) This Act may be called the Orissa Court-fees (Surcharge Amendment) (Amendment) Act, 1951. (2) It shall come into force at once. Section 2 - Amendment of the Schedule For the Schedule appended to Orissa Court-fees (Surcharge Amendment) Act, 1947 (Orissa Act XX of 1947) the following Schedule shall be substituted, namely: THE SCHEDULE [See Section 2] Rates of surcharge on fees leviable under the Court-fees Act, 1870,- in its application to Orissa Rate of Surcharge 1. On every whole rupee Eight annas per rupee 2. (a) On a fraction of a rupee up to and including four annas Two annas (b) On a fraction exceeding four annas but not exceeding eight annas Four annas (c) On a fraction exceeding eight annas but not exceeding twelve annas Six annas (d) On a fraction excluding twelve annas but less than sixteen annas Eight annas .....
