The Maharashtra Slum Areas (Improvement, Clearance and Redevelopment) Act, 1971 Complete Act

.....design of such buildings, narrowness or faulty arrangement of streets, lack of ventilation, light or sanitation facilities or combination of these factors, detrimental to the health, safety or convenience of the public of that area, the Competent Authority may, by notification in the Official Gazette, declare such area to be a slum area. Such declaration shall also be published in such other manner (as will give due publicity to the declaration in the area) as may be prescribed.] (2) In determining whether buildings are unfit for human habitation for the purposes of this Act, regard shall be had to the condition thereof in respect of the following matters, that is to say,- (a) repairs; (b) stability; (c) freedom from damp; (d) natural light and air; (e) provision for water-supply (f) provision for drainage and sanitary conveniences; (g) facilities for the disposal of waste water; and the building shall be deemed to be unfit as aforesaid, if and only if, it is so far defective in one or more of the said matters that it is not reasonably suitable for occupation in that condition. .....after investigating into the complaint under sub-section (4) submit his report to the Court, within the time specified by it, setting out the full facts and circumstances of the case, and the efforts made by him in settling the complaint. The Court shall, on demand and on payment of such fee as may be prescribed by rules, supply a copy of the report to the complainant and the person complained against. (6) If, on receipt of the report of the Investigating Officer, the Court finds that the complaint has not been settled satisfactorily, and that facts and circumstances of the case require, that the matter should be further considered by it, the Court shall proceed to consider it, and give its decision. (7) The decision of the Court, which shall be in writing, shall be in the form of an order. The order of the Court shall be final and shall not be called in question in any civil or criminal court. (8) The Court shall cause its order to be published in such manner as may be prescribed. The order of the Court shall become enforceable from the date specified in the order. THE BOMBAY BUILDING (CONTROL ON ERECTION, RE-ERECTION AND CONVERSION) (REPEAL) ACT 1971 [Act No. XLI of 1971]1 [08th November, 1971] PREAMBLE An Act to repeal the Bombay Building (Control on Erection, Re-erection and Conversion) Act, 1948. WHEREAS, it is expedient to repeal the Bombay Building (Control on Erection, Re-erection and Conversion) Act, 1948; it is hereby enacted in the Twenty-second Year of the Republic of India as follows :- INTRODUCTION In 1948, the Bombay Building (Control on Erection, Re-erection and Conversion) Act. 1948 was enacted. At that time, there was an acute shortage of having accommodation for industrial towns and cities in the State therefore, to regulate the supply of building materials (e.g. bricks, iron and steel, cement etc.) and rationing the supply to the needy, such Act to control the construction of buildings was enacted. During that shortage period, non-essential construction work was not allowed without permission. But when such situation was eased, the old Act, is now repealed. ______________ 1.
