IV-B. p. 127) In exercise of the powers conferred under sub-section (3) of section 1 of the Bombay Corneal Grafting Act, 1957 (Bom. XXXIII of 1957), the Government of Maharashtra specifies the 10th of August, 1960, to be the date on which the said Act shall come into force in all the areas of the State of Maharashtra. G. N., U. D., P. H. & H. D., No. DSP. 3768/6535-H, dated 13th October, 1969 (M. G., Pt. IV-B. p. 1522) In exercise of the powers conferred by clause (a) of section 2 of the Bombay Corneal Grafting Act, 1957 (Bom. XXXIII of 1957), the Government of Maharashtra hereby approves the following hospitals for the purposes of the said Act, namely :- (1) K.E.M. Hospital, Bombay. (2) Haji Bachooali Hospital, Bombay. (3) B.Y.L. Nair Hospital, Bombay. (4) St. George's Hospital, Bombay. (5) Parsee General Hospital, Bombay. (6) Bombay Hospital, Bombay. G. N., U. D., P. H. & H. THE BOMBAY ABOLITION OF WHIPPING ACT, 1957 [ Act No. 39 of 1957]1 [28th September, 1957] Amended by Maharashtra Repealing and Amending Act, 1991 (Mah. Act No. 22 of 1991). INTRODUCTION Whipping as a form of punishment was existing in the Pre-British and British India. Several instances can be found that this form of punishment was widely prevalent in the Presidency Area of Bombay during East India Company and thereafter. The old Act of 1909 provided for whipping as a possible punishment for several categories of offences criminal and civil. Convicted men, women, children, prostitutes, juvenile delinquents, prisoners and beggars were subjected to lashed. This barbarous punishment was abolished as there was an international movement against it. The Central Legislation was passed in 1955 and now whipping as a form of punishment is abolished. PREAMBLE An Act to provide for the abolition of whipping as a punishment in the State of Bombay. .....as such, immediately before the commencement of this Act. under the provisions of - (i) section 5 of the Bombay Land Revenue Code, 1879, or that section of the Code in its applica tion to the Kutch area of the State of Bombay; (ii) section 5 of the said Code in its application to the Saurashtra area of the State of Bombay arid read with the Government Notification in the Legal Department No. 25398/B, dated 1st November, 1956 issued under section 122 of the States Reorganisation Act, 1956; (iii) section 9-A of the Madhya Pradesh Land Revenue Code, 1954, read with Government Notification in the Revenue Department No. RVA. 1556-R, dated 1st November, 1956; or (iv) section 4 of the Hyderabad Land Revenue Act; (e) "existing law" means any enactment of a Legislature or other competent authority in relation to matters specified in lists II and III in the Seventh Schedule to the Constitution in force in any part of the State immediately before the commencement of this Act and includes any rule, by-law, regulation, order, notification, scheme, form or other instrument having the force of law made, prescribed or issued under any such commencement; (f) "Schedule" means the.....

The Legislature has not, in enacting sub-section (H) of section 3. parted with its essential legislative function. Title : Short Title, Extent and Commencement

(1) This Act may be called the Bombay Corneal Grafting Act, 1957. (2) It extends to the whole of the State of 1[Maharashtra]. The Bombay Corneal Grafting Act, 1957 Complete Act

.....provisions of this Act shall be construed as rendering unlawful any dealing with the body or any part thereof, of a deceased person which would have been lawful if this Act had not been passed. (2) Any authority for the removal of eyes given in accordance with the provisions of this Act shall not be deemed to be contravention of the provisions of Section 297 of the Indian Penal Code. SECTION 08: AMENDMENT OF BOM. XI OF 1949 In the Bombay Anatomy Act, 1949- (a)in the long title and preamble after the words "teaching institutions" the words "for therapeutic purposes or" shall be inserted ; (2) in section 2, in clause (1), for the words "to carry on anatomical examination and dissection" the words "for all or any of the purposes of this Act;" shall be substituted; (3) in section 5, in sub-section (1), after the words "approved institution" words "for any therapeutic purpose or" shall be inserted. In the Prisons Act, 1894 -- (1) in section 46,-- clause (12) shall be deleted; and in the proviso thereto, the words "or to whipping" shall be deleted; (2) in section 47, in sub-section (1), clause (4) shall be deleted; (3) in section 50, in sub-section (1) the words "or of whipping", shall be deleted; (4) in section 51, in sub-section (2) the words beginning with the words "and, in the case of offences" and ending with the words "reasons therefor" shall be deleted; (5) section 53 shall be deleted.
