Bombay Provincial Municipal Corporation Act, 1949 Complete Act

.....drains and polluted water from sinks, bath -rooms, stables, cattle-sheds and other like places, and includes trade effluent and discharges from manufactures of all kinds ; (61) "special fund" means a fund constituted under section 91 ; (62) "standing order" means an order made under section 466 ; (62A)1[ "State Election Commission" means the State Election Commission consisting of the State Election Commissioner appointed in accordance with the provisions of clause (1) of article 243 -K of the Constitution of India;] (63) "Street" includes any highway, and any causeway, bridge, viaduct, arch, road, lane, footway, sub-way, court, alley or riding path or passage, whether a thoroughfare or not, over which the public have a right of passage or access or have passed and had access uninterruptedly for a period of twenty years, and when there is a footway as well as a carriage way in any street, the said term includes both ; (64) "Sweetmeat shop" means any premises or part of any premises used for the manufacture, treatment or storage for sale or for the sale, wholesale or retail of any ice cream, confections or sweetmeats whatsoever, for whomsoever intended, and by whatsoever name the.....

Title : Method of Compensation for the Extinguishment or Modification of Any Rights in Land

.....extinguishment or modification of any other right of a khot or any right of any other person the Collector shall be guided by the provisions of sub-section (1) of section 23 and section 24 of the Land Acquisition Act, 1894 : Provided also that, if any question arises whether any land is dhara, khoti khasgi or khoti nisbat or is held by a perma nent tenant or other tenant, the Collector shall after holding a formal inquiry in the manner provided by the Code decide the question. 3[(3A)(i) Where the officer making an award under sub section (3) is a Collector under this Act but not a Collector appointed under section 8 of the Code and the amount of such award exceeds five thousand rupees, then the award shall not be made without the previous approval of - (a) the Collector appointed under section 8 of the Code, if the amount of the award does not exceed twenty-five thousand rupees, or (b) the Commissioner, if the amount of the award exceeds twenty-five thousand rupees but does not exceed one lakh of rupees, or (c) the State Government, if the amount of the award exceeds one lakh of rupees. Bombay Khoti Abolition Act, 1949, (Maharashtra) Section 13

Every appeal made under this Act to the 1[Maharashtra Revenue Tribunal] shall be filed within a period of sixty days from the date of the award of the Collector. The provisions of sections 4, 5, 12 and 14 of the Indian Limitation Act, 1908*, shall apply to the filing of such appeal. _________________ 1 These words were substituted for the words Bombay Revenue Tribunal , by the Maharashtra Adaptation of Laws (State and Concurrent Subjects) Order, 1960. Subsequently the words "Divisional Commissioner" were substituted by Mah. 25 of 2002 and again the words "Maharashtra Revenue' Tribunal" were substituted by Mah. 23 of 2007, Sch., Serial No. 15(7). * See now Limitation Act, 1963 (36 of 1963).
