.....discharged or reverted under sub-section (3) shall be given preference in the matter of future appointments to the same post. (5) On satisfactory completion of probation, the educational agency shall confirm the teacher in the post and if the vacancy is not a substantive vacancy, the teacher shall be allowed to continue in the post for the duration of the vacancy. (6) If, on the expiry of the prescribed period of probation, the educational agency decides that the teacher is not suitable for continuance in the post in which he is appointed, it shall discharge him from service or revert him to his original appointment, as the case may be, after giving him a reasonable opportunity of showing cause against the action proposed to be taken in regard to him. (7) Where the post held by the probationer is substantively vacant and before the expiry of one month from the prescribed period of probation he is not confirmed under sub-section (5) or is not discharged or reverted under sub-section (6), he shall be deemed to have been confirmed in that post. (8) A probationer who is discharged or reverted under sub-section (6) or who is discharged or reverted before the prescribed.....

.....and repair works .-(1) Every person shown in the statement prepared under section 14 as liable to maintain and repair any work shall, to the satisfaction of the Corporation, maintain and repair that work in his own land and in any other land in respect of which he is shown as liable in the said statement. (2) If any person liable to maintain or repair a work fails to do so, the Corporation shall issue a notice to him requiring him to maintain or repair it within a period to be specified in such notice and, on his failure to comply with such direction within the time fixed by the Corporation, the Corporation shall cause, the work to be maintained or repaired, and the expenses incurred thereby shall be recovered from the owner and such other persons, if any, liable to contribute. (3) Any dispute as to the amount to be recovered under sub section (2) shall be decided by the Corporation and such decision shall, subject to the provisions of section 16, be final. 16. Appeals .-[15][(1) Any owner or other person liable under section 10 to pay the cost or part of the cost of any work or to pay any amount by way of contribution, who objects to such liability, or any owner.....

THE KERALA CASHEW FACTORIES (ACQUISITION) ACT, 1974 [1] THE KERALA CASHEW FACTORIES (ACQUISITION) ACT, 1974 [1] (ACT 29 of 1974) Act to provide for the acquisition, in the public interest, of certain cashew factories. Preamble.- WHEREAS it is expedient, in the public interest to acquire certain cashew factories to prevent large scale unemployment among the workers in the cashew industry and to provide employment to the workers who have been rendered unemployed and to secure to them just conditions of service ; BE it enacted in the Twenty-Fifth Year of the Republic of India as follows:- I. Short title, extent and commencement .-(1) This Act may be called the Kerala Cashew Factories (Acquisition) Act, 1974. (2) It extends to the whole of the State of Kerala . (3) It shall come into force at once. 2 . Definitions .-In this Act. Unless the context otherwise requires,- (a) "appointed day" means the date of publication of the declaration under Sub-section (1) of section 3 [2] (or under sub-section (1) of section 3A) (b) "Cashew factory" means a factory as defined in the Factories Act, wherein processing of cashewnuts is being carried on and includes the.....

(2) Notwithstanding such repeal, anything done or any action taken under the principal Act as amended by the said Ordinance shall be deemed to have been done or taken under the principal Act as amended by this Act as if this Act had come into force on the 20 th day of November, 1973. Explanation II.• For the purposes of this clause, clause (7A), proviso to sub-section (1) of section 3, clause (a) of sub-section (3) of section 10, section 16A, and section 17, the word ˜person' shall include " a firm or a joint family;" 3. Short title and commencement.--(1) This Act may be called the Kerala Agricultural University (Amendment) Act, 1974. (2) It shall be deemed to have come into force on the 27th day of November, 1973. 2. Amendment of section 61.--In sub-section (2) of section 61 of the Kerala Agricultural University Act 1971 (33 of 1971) (hereinafter referred to as the principal Act), for the words "two years" the words "three years" shall be substituted. 3. Repeal and saving.--(1) The Kerala Agricultural University (Second Amendment) Ordinance, 1973, (16 of 1973) is hereby repealed.
