1) If any chemist, druggist, apothecary or keeper of a dispensary allows any 96a96a. Word subs. for the word "excisable article" by the Government of India (Adaptation of Indian Laws) Order, 1937. [intoxicant] which has not been bona fide medicated for medicinal purposes to be consumed on his business premises by any person not employed in his business, he shall be liable to imprisonment for a term which may extend to 9797. Words "the Board" rep. by Ben. Act 7 of 1914. [one year], or to fine which may extend to 9898. Word, figure and brackets ins. by W.B. Act 34 of 1965. [three thousand] rupees, or to both.
(2) If any person not employed as aforesaid consumes any such 96a96a. Word subs. for the word "excisable article" by the Government of India (Adaptation of Indian Laws) Order, 1937. [intoxicant] on such premises, he shall be liable to 9999. Words subs. for the words "or transport" by W.B. Act 34 of 1965. [imprisonment for a term which may extend to three months or to fine which may extend to one thousand rupees or to both].
