both inclusive), makes default in complying with any of the provisions of this Act, or with any order issued under it, or, in the case of a licensee, with any of the conditions of his licence,159[or in the case of a person who has obtained the sanction of the State Government under Sec. 28-, with any of the conditions of the sanction], shall be punishable with fine which may extend to one hundred rupees, and, in the case of a continuing default, with a dally fine which may extend to twenty rupees: Provided that, where a person has made default in complying with any of the provisions of Secs. 13- ,14-15-,17-and32-, as the case maybe, shall not be so punishable if the Court is of opinion that the case was one of emergency and that the offender complied with the said provisions as far as was reasonable in the circumstances. STATE AMENDMENT Tamil Nadu.-In Sec. 47 of the Act of 1910: Substitute the words, figures and letter "Sec. 39, Sec. 39-A or Secs. 40 to 46" for the words and figures "Secs. 39 to 46". (Tamil Nadu Act 39 of 1980, Sec.6).
