Agreement for transport of goods at owner's risk
THIS AGREEMENT made at ...............day of ...............20 between A B Transport Co. Ltd., a company registered under the Companies Act, 1956 and having its registered office at ............hereinafter referred to as "The Transporter" of the ONE PART and M/s. ...............X Y & Co., a partnership firm carrying on business at ...............hereinafter referred to as the Consignor of the OTHER PART.
WHEREAS the Consignor has to export certain goods to for which the said goods have to ...............be transported to ...............
AND WHEREAS the Consignor has requested the transporter to...............transport the goods, particulars of which have been given in the Schedule herein written from his god own at ...............to...............for export;
AND WHEREAS the transporter has agreed to carry the said goods...............as...............aforesaid at the Consignor's risks on the terms and conditions hereinafter appearing.
NOW IT IS AGREED BETWEEN THE PARTIES AS FOLLOWS:
(1)The transporter will transport the Consignor's goods mentioned in the Schedule hereunder written, hereinafter referred to as "the goods" in its vehicles from the Consignor's godown at ...............to............... at the Consignor's risk.
(2) The Consignor has paid a sum of Rs . ...............to the Transporter (receipt whereof the transporter acknowledges) for transporting the goods as aforesaid. The Consignor will not be liable to pay any other charges or expenses to the transporter.
(3) The transporter will load the goods on ...............and the said goods will be delivered to M/s . ...............forwarding agents at their godown at...............on or about...............
(4) The goods are to be transported at Consignor's risk and transporter will not be responsible for any loss or damage caused to the at...............said goods due to theft, accident or any other reason whatsoever except on account of any negligence on the part of transporter or his agents or servants.
(5) The goods will be carried by the transporter by such route as he may think fit.
(6) The Consignor declares that the goods are not dangerous or offensive in nature and he will indemnify the transporter against any loss, claim, damage or expenses suffered, incurred or caused to him due to goods, if any.
(7) The transporter undertakes and declares that its vehicle is registered under Motor Vehicles Act, 1988 and it holds valid permit, insurance and its driver holds valid driving licence and agrees to indemnify the Consignor against any loss, cost, expenses and charges that the Consignor may suffer or incur due to any breach of the said laws.
(8) This Agreement will terminate on the delivery of the goods to M/s...............
(9) This Agreement will be subject to the provisions of the Carriers Act, 1865.
(10) This Agreement shall be executed in duplicate. The original
shall be retained by the Consignor and the duplicate by the transporter.
