Deed Of Conveyance By A Legal Guardian Of A Minor Deeds Property 1901 - Legal Draft

......... between Master ............. a minor below the age of twenty one by his duly appointed legal guardian Mr ............hereinafter referred to as the 'Vendor of the one part and Mr 'X' hereinafter referred to as the 'Purchaser' of the other part.
WHEREAS
(1) The said minor Master ............owns an immovable property consisting of land and building thereon situate at ........... and more particularly described in the Schedule hereunder written.
(2) By an order dated the ............. day of .........passed in petition No .......... the District Court/High Court at ............has appointed the said Mr ........... as the legal guardian of the properties of the said minor.
(3) As it is not in the interest of the said minor to keep the said property described in the Schedule hereunder and there are also certain liabilities required to be paid in respect of the estate of the said minor, the said Mr ........... proposed to sell the said property at the best price available and after some negotiations entered into an agreement for sale of the said property at the price of Rs .......... with the Purchaser subject to the sale being approved - by the District Court/High Court at ............
(4) The said Mr ............. accordingly applied to the District Court/High Court at ............. by petition number .......... for permission to sell the said property in terms of the said agreement under Sec 29 of the Guardians and Wards Act 1890
(5) By an order passed on the day of .........in the said Petition the District Court/High Court at ............after obtaining valuation report from experts and verifying the correctness thereof and other matters sanctioned the sale of the said property in terms of the said agreement, subject to the sale proceeds being secured in the manner mentioned in the said order and authorised the said guardian Mr ........... to execute the deed of conveyance in favour of the Purchaser in terms of this said agreement for sale.
(6) The Purchaser has now requested the Vendor through his legal guardian to execute these Presents which the said guardian has agreed to do
(7) Now this Deed witnesseth that pursuant to the said agreement for sale and the sanction thereto granted by the District Court/High Court at   as aforesaid and in consideration of the sum of Rs .......... paid by the Purchaser on the execution of the agreement for sale as earnest money and in consideration of the balance sum of Rs .............. paid on the execution of these Presents by the Purchaser to the Vendor making together the sum of Rs ........ being the full consideration agreed to be paid by the Purchaser to the Vendor as aforesaid (receipt whereof the Vendor doth hereby admit) he the Vendor by his said legal guardian doth hereby grant and convey to the Purchaser the said immoveable property described more particularly in the Schedule hereunder written together with all things permanently attached to and standing thereon and all the privileges easements, profits, advantages, rights and appurtenances whatsoever to the said property belonging and all the estate, right, title and interest, use, possession, benefit, claim and demand whatsoever at law or otherwise of the Vendor to the said property and other premises hereby conveyed and every part thereof To Have and, To Hold the same unto and to the use of the Purchaser absolutely and forever but subject to the payment of all taxes, assessments, dues and duties now chargeable or payable or hereafter to become chargeable or payable in respect of the said property hereby conveyed, to the Government or any local authority or other public body And the Vendor by his said legal guardian, Covenants with the Purchaser that he the legal guardian has not done any act deed matter or thing whereby or by means whereof he is prevented from conveying the said property to the Purchaser in the manner aforesaid.
