Deed of conveyance of Agricultural Law

THIS INDENTURE made this ............... day of ................... Dist ............ hereinafter called and referred to as the VENDORS (which expression shall unless repugnant to the context or meaning thereof be deemed to include their heirs, executors, administrators representatives and assigns) of the one part;

AND

.................................., a society registered under the societies Registration Act XXVI of 20...... and having its office at village ......., Taluka ........ Dist ........... (which expression shall unless repugnant to the context or meaning thereof be deemed to include its executors, administrators, representatives, hereinafter called the purchase of the other part;

WHEREAS the vendor are seized and possessed of and otherwise well and sufficiently entitled to the absolute owners of the land and more particularly described in the schedule hereunder written in all admeasuring about Hectares .............., R. .......... situated, lying and being at village ..................., Taluka ................, Dist................ and bounded by the RED colour boundary lines in the plan hereto annexed; AND WHEREAS the purchasers approached the vendors for purchasing the said land admeasuring Hectares ........... R. ................. more particularly and fully described in the schedule below; AND WHEREAS the vendors have agreed with the purchasers for the absolute sale of the said land admeasuring Hectare .............,R. ...............free from all encumbrances at or for the total consideration of Rs..................../-

AND WHEREAS the purchaser has paid to the vendors a sum of Rs............/-(Rs............ only), i.e. Rs ............./- on ............. and Rs............ (which the vendors hereby acknowledge) towards earnest money.

NOW THIS INDENTURE WITNESSETH that in pursuance of the said agreement and in consideration of the sum of Rs.............../- (Rupees........................only) including the earnest money paid to the vendors by the purchasers (the receipt whereof the vendors hereby acknowledge )and of and from the same and every part thereof for ever acquit, release and discharge the purchasers and the vendors doth grant, release convey, transfer, assure and assign unto and to the use of purchaser ALL THAT the piece of land admeasuring hectares ............. R ............. situate, lying and being ................ village.........., Taluka ................, Dist.............in the state of Maharashtra more particularly described in the schedule hereunder written and delineated in the annexed plan or map with RED borders which is to be considered as part of this Deed herein written TOGETHER WITH all roads way, water, courses, light liberties, right, privileges, trees, profit advantages, easement and appurtenances whatsoever to the said land, hereditaments and premises or any part thereof, belonging or in any wise appertaining or usually held, used or occupied or enjoyed therewith or reputed to belong or be appurtenant thereto AND TOGETHER WITH all roads way, water, courses, light liberties, rights, privileges, trees, profit, advantages, easement and appurtenances whatsoever to the said land, hereditaments and premises or any part thereof, belonging or in any wise appertaining or usually held, used or occupied or enjoyed therewith or reputed to belong or be appurtenant thereto AND TOGETHER ALSO WITH full and free right and liberty for the purchasers their successors and executors, administrators and assigns the owner or owner or occupiers for the time being of the said premises or any part thereof their tenants agent, servants and persons authorised by them at all times hereafter their will and pleasure by day or by night and for all purpose with or without animals carts, carriage, wagons, tractors engines, motor cars or any vehicles laden or unlading to go pass and repass from the public road from and to said land hereditaments and premises hereby conveyed transferred and assured;

AND ALL THE estate right, title, interest, property, claim and demands whatsoever of law and in equity of the vendors of in and to the said land hereditaments and every part thereof.

AND ALL deeds pattas and miniments of title whatsoever relating to or concerning the said land which are now or at any time hereafter shall or may be in the custody, possession or the power or control of the vendors on any other person or person from whom they may produce the same To HAVE TO HOLD the said land hereditaments and premises and every part thereof hereby granted sold conveyed, transferred or expressed and intended to be unto and to the use and benefit of the purchaser absolutely and for ever subject to the payment of all rents, rates, taxes, assessments, duty and duties chargeable upon the same now or hereafter to become payable to Government or Maharashtra or to the Municipality or any other public body in respect thereof; and the vendors do and each of them do hereby for themselves and their successors and assigns with the purchasers that notwithstanding any act, deed, matter or thing whatsoever by the vendors or by any person or persons lawfully or equitably claiming from, under or in trust for them made, done, committed or executed knowingly or willingly suffered to the contrary, they the vendors now have in themselves good right AND absolute power to grant, release, convey transfer and assure the said premises unto and to the use of the purchaser in manner aforesaid free from all encumbrances AND THAT it shall be lawful for the purchaser, from time to time and at all times hereafter peaceably and equitably to hold, possess and enjoy the said premises hereby granted with their appurtenances, and receive the rents and profits thereof for their own use and benefit without any lawful eviction, interruption claim or demand whatsoever from or by the vendors or their successors and assigns or from or by any other person or persons lawfully or equitably claiming by from under or in trust for them or any of them AND THAT free and clear, and freely and clearly and absolutely acquitted, exonerated released and for ever discharged or otherwise by the vendors sufficiently saved, defended, kept harmless and indemnified of from and against all estates, charges and encumbrances whatever either already or to be hereafter had, made, executed, occasioned and suffered by the vendors or by any other person or persons lawfully or equitably claiming by, from under or in trust for them AND FURTHER that the vendors and all persons having or lawfully or equitably claiming any estate, right, title or interest at law or equity in the said premises hereby granted, conveyed, transferred or any part thereof by from, under or in trust for them ,the vendors shall and will from time to time and at all times hereafter at the request and cost of the purchasers do and execute or cause to be done and executed all such further and other lawful and reasonable acts, deeds, things, matters and assurances in the law whatsoever for further and more perfectly and absolutely granting and assuring the said premises hereby granted unto and to the use of purchasers in matter of aforesaid as shall or may be reasonably requested by the said purchasers ,its successors and assigns and the vendor have not done, omitted or knowingly or willingly suffered or been party or privy to any act, deed or thing whereby they are prevented from granting and conveying the said property in manner aforesaid or whereby the same or any part thereof are, is, can or may be charged encumbered or prejudicially affected in estate, title and interest howsoever.
