Deed of Confirmation
THIS DEED OF CONFIRMATION made entered into at ................................... this ................... day of March, Two Thousand One by Mr. .............................. Indian Inhabitant residing at ........................., ................................................., hereinafter called THE CONFORMER which expression shall unless repugnant to the context or meaning thereof, be deemed to mean and include his heirs, executors, administrators, assigns of the first part.
AND MR. .........................................., residing at ...................................... hereinafter called THE VENDER, which expression shall unless repugnant to the context or meaning thereof, be deemed to mean and include his heirs, executors, administrators, successors and assigns of the other part.
WHEREAS :
1. By an agreement ......................................... day of .................., 20......., made between the confirmer, therein referred to as THE TRANSFEREE of the one part, and the vendor therein referred to as THE TRANSFEROR of the other part, the vendors agreed to sell to the confirmer all the rights, title and interests of the vendor in the premises being Shop No.........., in the building known as ............................................... hereinafter referred to as “THE SAID PREMISES” and more particularly described in the schedule hereunder for the consideration and on the terms, conditions mentioned herein.
2. The confirmer have failed to appear before the Sub-Registrar of assurance of ............... of register the said agreement dated......... day of ............, 20...... under the provisions of section 4 of the Maharashtra Ownership Flats (Regulations of promotions of constructions, Sales Transfer (Act) 1993 read with Indian Registration Act, 1908, to admit execution by him, within the prescribed period and thereof, the Sub-Registrar has referred registration of the said agreement as far as the Confirmer is concerned.
3. The confirmer herein is desirous of confirming the said agreement dated the ............ day of ..............., 20....... entered into by the parties in respect of the said premise with an intention to pay the stamp duty as per the Bombay stamp Act, 1958.
AND MR. .........................................., residing at ...................................... hereinafter called THE VENDER, which expression shall unless repugnant to the context or meaning thereof, be deemed to mean and include his heirs, executors, administrators, successors and assigns of the other part.
WHEREAS :
1. NOW THIS DEED OF CONFIRMATION WITNESSETH AS FOLLOWS :
1. The confirmer hereto do hereby confirm as valid and subsisting the said agreement dated .......... day of ............, 20........ made between the parties hereto in respect of the said premises. Hereto annexed and marked Exhibit “A” is the said agreement.
2. The confirmer hereto agree and confirm that pursuant to the said agreement the parties hereto have carried out their respective obligations under the said agreement and nothing remains to be done on the part of the either party hereto and that the vendor has sold the said premises to the confirmer.
3. The confirmer hereto further confirm all the terms and conditions within mentioned in all respects as if the confirmer have been appeared before the sub-registrar of assurance at ............. within the time limit presented to the said agreement dated ......... day of ......., 20....... for registration and admitted execution thereof to the end and intend that the said agreement date ................ day of ................, 20......
4. The confirmer’s hereby confirm that the parties have already paid the stamp duty applicable under the act in the absence of vendor and has informed to the vendor. The vendor has agreed to remain present before the sub-registrar / respective authorities for registration of the said agreement dated ............, 20......
