Occupation Business & Mr. ....................................... aged ............. years, Occupation Service both residing at ..................................................... hereinafter referred to as “ THE TRANSFERORS” ( which expressin shall unless it be repugnant to the context or meaning thereof mean and include their heirs, executors, administrators and assigns ) of the ONE PART.

AND

MR. .......................................... Aged ......... years, Occupation Business, residing at ............................ hereinafter referred to as “ THE TRANSFEREE” ( which expression shall unless it be repugnant to the context or meaning thereof mean and include is heirs, executors, administrators and assigns ) of the SECOND PART.

WHEREAS initially Smt ................................. has purchased vide agreement for sale dated ..................... and registered with Sub registrar .......... on .......................... under document No. ............. She expried on .............. thereafter her sons .................... & .................. as a legal heir approached the society to transfer in their name and society did the same and they became the owner of the flat in the society where their mother was the member of the society.

AND WHEREAS Transferors Mr. ............................ & .................... are seized and possessed of an otherwise well and sufficiently entitled to the piece and parcel of a self- contained ownership flat, bearing flat No............ on ............ floor, admeasuring ........... Sq. ft. built up area, in the building known as .............................. (more particularly described in the Schedule written hereunder), as its true, absolute, and exclusive owner thereof, hereinafter for the sake of brevity and convenience called and referred to as “THE SAID FLAT”

WHEREAS THE ..................................... Which is a corporate body, a Co-operative Housing Society, duly formed, registered and incorporated under provisions of Maharashtra Co-operative Society’s Act, 1960, bearing Registration No. ................ it ......................

AND WHEREAS THE Transferors are a bonafide member and shareholder of THE SAID SOCIETY, holding ............ shares of Rs. ................. each , total Rs ..........., bearing Distinctive Nos. ................ to ................ & Certificate No .............. by THE SAID SOCIETY in favour of THE Transferors.

AND WHEREAS THE Transferors are no more in need of the said flat and therefore they have decided to dispose off the same in favour of a prospective Transferee.

AND WHEREAS THE Transferors was seeking suitable flat for his own residential purpose in the said area, who got a information that THE Transferors is in readiness to transfer THE SAID flat absolutely on ownership basis.

AND WHEREAS THE Transferee approached THE Transferors with a view to inspect the said flat and to examine the documents of the title and if the same found to be feasible then to move the proposal for the transfer therof in his favor.

AND WHEREAS THE Transferee has inspected The Said flat and examined the documents of title and found The Said flat to be suitable for his own residential purpose and therefore moved the proposal for the purchase thereof on certain terms and conditions and upon certain considerations.

AND WHEREAS THE Transferors AND THE Transferee held various meetings, discussions, bargains and negotiations and as a result thereof, they have concluded the agreement for Transfer of The Said flat to be suitable for his own residential purpose and therefore moved the proposal for the purchase thereof on certain terms and conditions and upon certain considerations.

AND WHEREAS THE Transferors AND THE Transferee have decided to reduce into writing the said terms and conditions and considerations.

NOW THIS AGREEMENT OF TRANSFER WITNESSETH AND IT IS HEREBY AGREED BY AND BETWEEN THE Transferors AND THE Transferee, AS UNDER THAT IS TO SAY;

1. THE Transferors, hereby agrees to assign , dispose off, convey, and transfer The Said flat No. ........................... on .......... Sq. ft. built up area, in the building known as ....................... on absolute ownership basis, in favour of the Transferee AND THE Transferee hereby agrees to purchase and acquire The Said felt from THE Transferors on the following terms, conditions and considerations.

2. The Transferee has agreed to pay the sum of Rs ............ (Rupees ............ only) to the Transferors in the following manners.

3. The Transferors further declares that they have obtained the necessary permission from the society for sale and transfer of the said flat/shares unto the Transferee herein.

4. THE Transferors hereby agrees to hand over the vacant and peaceful possession of the said flat to THE Transferee, after receipt of full payment as agreed hereinabove.

5. THE Transferors agrees that they will sign all the applications for transfer of the said falt and for the transfer of the electricity meter and receding The Said falt in the name of THE Transferee, after handing over the possession of The said flat or after receipt of the full payment.

6. THE Transferors hereby agrees, admits, and declares that The Said flat is their absolute, exclusively owned property. IT IS ALSO DECLARED THAT they are entitled to and having absolute right and authority to sell, dispose off and transfer The Said flat in favour of THE Transferee and that no other person has any claim share, right, title and/or interest in respect of The Said flat of any nature whatsover.

7. THE Transferors hereby declares that they shall pay all taxes, cess, maintenance charges , water charges, electricity charges, till the date of handing over the possession of The Said flat and if any taxes, cess, maintenance charges, water charges, electricity charges and loan found to be due, payable for the period earlier to the date of handing over the possession the same will be repaid by the Transferors before final transfer.

8. THE Transferors hereby further declares and agrees that they have not done any act or deed nor they have committed to do any whereby they are prevented form entering into these presents in respect of The Said flat.

9.THE Transferors hereby agrees and declares that they will produce the original documents of the agreement copy, registration receipt, share certificate, electricity bill and other relevant documents to THE Transferee at the time of execution of this agreement for enabling THE Transferee to secure the title to The Said flat.

10. The Electric meter bearing No. ................... and Consumer No. ............... is affixed to the said flat and the Transferors has agrees to transfer the said flat alongwith the said Electric Meter and connection to the Transferee and further agrees to sign all the necessary paper for transfer of such electric meter.

11. All costs and incidental expenses to this agreement will be borne by the Transferee.

12. The Transferee shall bear and meet the expenses of the registration of the agreement if the same needs Registration with Sub-registrar, .........................

13. The Transferors agrees to Co-operate and whenever required sign all papers pertaining to transfer of this flat.

14. The necessary transfer charges/donation to the society will be borne by the Transferors and the Transferee equally.

15. The Transferors agrees to pay all their dues till today including Electric Bill, water Bill, Maintenance and taxes Bill etc. and the Transferee will not be made liable for the same.

16. The possession of the flat will be handed over to the Transferee on the day of execution of this agreement and registration
