Will

I,........................ Hindu Indian Inhabitant aged about ....... Years residing at .........................make this my last will and testament on this ......... day of ........ I have not made any will or codicil heretobefore and if any such will and codicil is found, I hereby revoke and cancel the same and declare this as my last will and testament.

WHEREAS my family consists of the following members :

(1) Myself
(2) Smt.......................... wife aged ....... Years.
(3) Shri......................... married son aged ....... Years, residing at ...............
(4) Shri....................... unmarried son aged .......... Years residing at ..............
(5) Shri ....................... married son aged ............... years residing at.......................

I hereby appoint Shri...................., my eldest son, as the executor and trustee of this my last will . For the sake of convenience I declare him hereafter as my executor.

I direct my executor to obtain Probate of this my last will, if necessary, making all expenses for the same from my property.

AND WHEREAS I am now ........ years old and have been keeping indifferent health for the past few years.

AND WHEREAS I am possessed of some moveable and immovable properties more particularly described below which are my self-acquired properties and which were acquired without any detriment to the ancestral property or to the family funds and I have the absolute powers of disposal over the same.

(1) One fully furnished flat, being Flat No. 15 at the aforesaid address.
(2) Debentures and shares worth about Rs..........
(3) Jewellary (described as under)
(4) Household items.
(5) Some each in ...........................Bank.

The flat, debenture and shares are jointly held by me and my wife. On my death, these will pass on to my wife and after her death to our sons (1) ................ (2) ............... (3) ................ And all the three will equally share the money and other benefits accruing therefrom.

Jewellery belongs to my wife and she will make the decision as to whom it will go after her death. She received and friends, from my father and other relatives from my side, and some she acquired during the years of her married life.

Household items as far as possible should not be sold, but could be offered optionally to close relatives like my younger brother and his family. Mrs.......................... and her family and my ............. Sisters. The items which are not useful should be given to any charitable trust like ..............................

An amount of Rs.............. (Rupees..............) should be given to ......................... For the purpose of utilizing the same in their hospital.

Mr.............................. residing at ........................... has been very helpful to me in these years. I appreciate his help and would leave Rs.............. (Rupees......) for him. In case I am alive when we move out of .......... I will give this amount to him personally.

As I write this will I am in the process of selling my abovementioned Flat............... in ..................... from Income Tax Department before the flat can be transferred and delivered. In case I am not alive at that time, my wife Mrs........................ who inherits this property will receive the payment and give possession of the flat to the purchaser. In case she too is not alive then the property goes to my .................... Sons ....................... and ................... Mr............. being the eldest and is the executor of this Will will complete the deal and deliver the flat to the purchaser amount by way of Banker’s pay order or a Bank Draft drawn on ........................... Bank which will be deposited in the Current Account No......... in the said Bank in the joint names of ........................ and ................... This amount will belong equally to the ......... sons and can be used by them as they deem best.

In case my wife is alive when the deal materializes she being the legal heir would receive the purchase amount. Since she is old and not keeping good health she will not be able to manage such affairs and will need assistance and counsel from her sons. Mr...................... being the eldest should perform this duty with the help and suggestions of his two younger brothers.

My wife should be allowed to stay wherever she desires. If she prefers to stay with my younger brother ................... at ......................... and if he need some money expand the home for better accommodation she should be given. If she prefers to stay in a house nearby, an arrangement to this effect should be made by hiring or purchasing a house. For her normal expenses, I suggest that about Rs.......... lakhs (Rupees ..........) should be deposited in a reputed bank. Out of this about Rs............ (Rupees...........) should be kept in current account and remaining in fixed deposit to be converted as and when she desires and at the same time giving her interest. This arrangement could be changed for better on expert advice and with her concurrence.

The rest of the money should be invested on expert advice after confirmation from my three sons.

After the death of my wife all the properties will go to our ................. sons in equal proportion.

If any other residue assets remain or if any more assets are acquired from now on the same will go to my wife after my death and after her death the property will be divided equally amongst my .............. sons. In case of any differences or disputes between the brothers, it should be settled amicably and if need be advice from Mr....................., Mr............... or Adm. .............. or any other person mutually agreed upon should be taken to settle such differences or disputes.
