.........per month in advance on or before the 5th day of each month hereafter and it is agreed between the parties that the payment would be a charge on the property of the Party of the First Part, being the land and premises situate at ................ and more particularly described in the Schedule hereunder written in the manner following:
NOW THIS DEED WITNESSETH and it is agreed by and between the parties hereto that the payment of the said sum of Rs .................... per month by the Party of the First Part to the party of the Second Part and such smaller or larger amount as may hereafter be agreed upon between the parties from time to time as and by way of maintenance payable by the Party of the First Part to the Party of the Second Part shall be a charge on, and the Party of the First Part hereby charges, the said land and premises with the payment of the said liability to pay maintenance to the Party of the Second Part.
AND IT IS AGREED THAT in the event of the party of the First Part failing to pay any monthly instalment or instalments when the same becomes due and payable, as hereinbefore stated the Party of the Second Part will be entitled to enforce the charge hereby created by bringing the said land and premises to sale through any competent court of law and to realise and receive the amount due out of the net sale proceeds thereof.
