THIS AGREEMENT OF LEAVE AND LICENSE made and entered into at ….……… on this ………. day of …..…………. BETWEEN Shri ………………. an adult, Indian Inhabitant residing at ….………………….. hereinafter called the “LICENSOR” (which expression shall mean and include his heirs executors, administrators and assigns) of the One PART AND SHRI ……………….……… S/o Shri ………………. An adult Indian Inhabitant presently residing at…………………. hereinafter called the “LICENSEE” (which expression shall mean and include his heirs, executors, administrators) of the OTHER PART.
AND WHEREAS the Licensor is the Owner of the Shop bearing No………. situated at ……………. Admeasuring about …….. sq. ft. hereinafter called the SAID SHOP.
AND WHEREAS the Licensee has approached and requested the Licensor to grant the permission to Licensee to use and occupy the said shop for business of …………. On Leave and Licensee basis for a period of ………. Months w.e.f. ……… to ………… and that the Licensor has agreed to grant the permission to the Licensee on the following terms and conditions :
NOW THIS INDENTURE WITNESSETH AS FOLLOWS :
1. The Licensor doth hereby grant leave & license to Licensee to use & occupy the said Shop No…….. situated at …..……….. for ……….. months viz., ………… to ………….
2. The Licensee shall pay to the Licensor a sum of Rs………. (Rupees………..) per month as licensee fee to the Licensor. The Licensee shall pay Rs………. by way of security deposit. The said deposit will be refunded to the Licensee without interest after license period is over. The licensee has paid only Rs……….. and remaining balance deposit of Rs……… the licencee agreed to pay within ….. months of execution of this agreement.
3. The Licensee shall pay the Electric and Water Bills/charges for electricity & water consumption in the said shop.
4. The Licensee shall use the Shop with proper care and caution for business purposes only and shall not create any lease, sub-lease tenancy or any right title and interest whatsoever nature in respect of the said shop.
5. The possession of the said shop shall always with the Licensor and the Licensor shall have right to enter and inspect the said Shop.
6. The Licensee shall not make any structural alteration in the said shop without prior written permission of the Licensor & the said shop be use for business purpose as mention earlier (Not for Resident)
7. The Licensee shall keep the said Shop in the a good condition and shall not cause any damage thereto and shall not create any nuisance or annoyance to the people or store any hazardous goods in the said Shop.
8, It is agreed between the parties that …… month notice shall be given by either of the parties if any of party desires to bring an end of this Agreement.
9. It is agreed that if Licensee commits beach of condition of this agreement than not withstanding anything herein contained, the Licensor shall be entitled to terminate this agreement forthwith.
10. On expiration of the said period the Licensee shall handover vacant and peaceful possession of the said Shop of the Licensor.
11. That this writing is binding on the parties.
