Written statement on behalf of the Opposite party.
To
The Hon'ble Judge of the aforesaid Court.
The opposite party most humbly showeth as under:
1. That there is no apprehension of breach of peace from the side of the opposite party. Rather the applicant himself is responsible for causing the breach of peace.
2. That initially Sri S/o ........................ D/o................ P. S. .................. District ................... was the owner of the disputed house who, vide sale-deed dated............ transferred the same to the opposite party and delivered the possession of it to the opposite party...........
3. That the opposite party is in exclusive possession of the disputed house since the date of the aforesaid sale-deed.
4. That the police has visited the disputed house on ............... and has found the possession of the opposite party over it.
5. That in the aforesaid circumstances, it is just and expedient in the interest of justice that the Hon'ble Court may be pleased to drop the proceedings under Section 145, Cr. P.C. and may also be pleased to restrain the applicant from interfering in the peaceful possession of the opposite party over the disputed house.
