The Hon'ble Judge of the aforesaid Court. The humble applicant/opposite most respectfully showeth as under:

1. That the Hon'ble has been pleased to pass an ex parte order under Section 133, Cr.P.C. on …………………… directing the applicant to immediate fencing of the disputed well.

2. That the complainant who launched the aforesaid case against the applicant has a long standing enmity with the applicant. The aforesaid proceedings under Section 133, Cr. P.C. have been instituted out of malice.

3. That the disputed well does not create any longer to the people of the locality on to the passerby. The old fencing have been removed by the applicant and the new fencing had been set up prior to the institution of the present proceedings. The new fencing adequately protects the well in dispute.

4. That no harm or injury has been caused to any person by falling into the disputed well. No incident, as alleged, of the failing into the disputed well has occurred for last one year.

5. That there is no danger or risk to the life or limb of the people from the applicant's well to the public.
