The Humble opposite party most humbly showeth as under:
1. That the opposite party is a peace loving and law abiding citizen while the complainant is a law breaker and a person of bad antecedents.
2. That the complainant's application under Section 116 (3) of Cr.P.C. is devoid of merits and liable to be objected.
3. That no incident as alleged by the complainant in para No. ………….. of his application under Section 116 (3) of Cr.P.C. ever occurred.
4. That the police has colluded with the complainant and has filed false report without even visiting the place of occurrence.
5. That the present application has been filed to harass the opposite party and to discourage the witnesses of the opposite party from deposing in favour of the opposite party in civil litigation between the complainant and the opposite party.
