1. That I am the Chief Accountant and Company Secretary of A B C Ltd., the assessee, and as such well conversant with the facts deposed to below.
2. That the appeal filed by the assessee-company before the Deputy Commissioner (Appeals) was disposed of by order dated ........................passed by the Deputy Commissioner (Appeals) .

That Chief Legal Adviser of the assessee-company Shri ......................was coming to the office of the tribunal to file the Memo of appeal duly signed by the Managing Director of the Company on ............by his Car No. ............................... and the said car met with an accident at with another Car bearing No ... and Shri ...........................Chief Legal Adviser, became unconscious on the spot, due to head injuries received by him in the said accident and he was immediately admitted in Nursing Home by the police.5. That I came to know about the accident in the evening of...........................and I went to visit him in the Nursing Home. When I enquired from him about the filing of appeal before the tribunal, he intimated that he met with the accident before reaching the tribunal's office, therefore, appeal could not be filed.
6 That I got prepared another Memo of Appeal from the company Solicitors on the next day i.e. on............as all the papers in the car including the appeal papers, have been seized by the police.
