now residing in , do hereby solemnly and on oath affirm and state as

follows:—

1. That I am the deponent herein and I am well conversant with the

facts and circumstances of the case. I am competent to swear to this

affidavit.

1. That it is submitted that this Hon'ble Court was pleased to pass

an order

in Miscellaneous Revision Case No of , restraining the

opposite party from disposing of the suit property during the pendency

of the case referred to above. Further, the said order was duly

communicated to the opposite party and the same is still very much in

force and has not been vacated or modified by this Hon'ble Court even

though a counter-affidavit had been filed by the opposite party for

vacating the order.

1. That the kind attention of this Hon'ble Court may be drawn to the

fact thatin blatant disregard and disobedience and defiance of the

aforesaid orderpassed by this Hon'ble Court, the opposite party has been

incessantlynegotiating with prospective buyers with a view to dispose of

the suitproperty.

1. That I have come to know from reliable sources that the opposite

party

has even accepted an advance of Rs from one Shri

towards the sale of the said suit property. Such conduct of the opposite

party is in clear contravention of the order of this Hon'ble Court.

Further, it lays bare the malicious and dishonest intention of the

opposite party in continuing to mock the law of the land.

1. That in view of the aforementioned facts and circumstances, the

oppositeparty is liable to be punished by detention in civil provision

and byattachment and sale of his property for having committed violation

of theinjunction order.
