I, W/o , aged years, presently and

permanently residing in , do hereby solemnly affirm and

declare as under:—

  1. I am the petitioner in the Miscellaneous application and the

petitioner in the Writ Application referred to above. I am well

acquainted with the facts and circumstances of the present case and I am

competent to swear to this affidavit.

  1. The Writ Application referred to above is filed seeking

Certiorari or such other writ, order or direction quashing Ex. P. 5

order passed by the 1st respondent to stop them from carrying on the

demolitions under their new Building Rules.

  1. This Hon'ble Court was pleased to order visual notice to be served

on the

respondents after admitting the Writ Application No The

notice was duly attempted to be served on the first respondent by the

deponent on However, the 1st respondent refused to

receive the notice and acknowledge the receipt of the same. This fact is

testified by the four witnesses who have signed on the back of the

notice taken out to him. In fact, the said notice was tendered alongwith

the copies of this writ application, exhibits, stay application and

affidavit.

  1. In view of the abovementioned facts, it has to be construed that

theservice of the said notice was affected on the 1 st respondent.
