I D/o aged years, presently and

permanently residing in , do hereby solemnly affirm and state as

follows:—

1. That I say, that I am the petitioner in the Original Petition

referred to above and in the accompanying Civil Miscellaneous Petition.

I am fully conversant with the facts and the circumstances of the case

and being so, I am fully competent to swear to this affidavit.

1. That I say, that the Original Petition is filed seeking, inter

alia, the issuance of a writ of Mandamus or such other writ, direction

or order directing the respondent to consider my tender and to give

permission to me to commence with the construction of the flyover

proposed to be built

1. That I say, that on the basis of Ex. P. 1 notification inviting

tenders, the respondent is likely to give permission to third party for

the purpose of carrying on the construction of the said flyover. I am

also submitting quotations in response to the said notification and the

respondent is likely to finalize the arrangements and get agreements

executed after confirming the action in pursuance, and on the basis of

the quotations received in response to the above Ex. P. 1 notification

and without considering my quotation. If the same is allowed to be

finalised pending the final disposal of the Original Petition, it will

cause irreparable loss, injury and hardship to me. In view of the

aforementioned circumstances the interim relief sought may be granted

urgently.

1. That I say, that I have not filed for the same relief in this

Hon'ble Court or any other Court.

1. That I say, that there has been absolutely no suppression or

concealment of facts on my part.
