Infringing copy, 'infringing copy' means,--(i) in relation to a literary, dramatic, musical or artistic work, a reproduction thereof otherwise than in the form of a cinematographic film;(ii) in relation to a cinematographic film, a copy of the film made on any medium by any means;(iii) in relation to a sound recording, any other recording embodying the same sound recording, made by any means;(iv) in relation to a programme or performance in which such a broadcast reproduction right or a performer's right subsists under the provisions of this Act, the sound recording or a cinematographic film of such programme or performance,if such reproduction, copy or sound recording is made or imported in contravention of the provisions of this Act. Producer
Producer, in relation to a cinematograph film or sound recording, means a person who takes the initiative and responsibility for making the work. [Copyright Act, 1957 (14 of 1957), s. 2 (uu)]In relation to a feature film, means the person by whom the arrangements necessary for the making of such film (including the raising of finances and engaging cine-workers for the making of such film) are undertaken. Copyright, an incorporeal right, being the exclusive privilege of printing, reprinting, selling, and publishing is own original work which the statute law first gave to an author in 1709, by 8 Anne, c. 19, for the term of fourteen years. Quota, the proportion of a contribution. Trader, imports buying and selling of commodities and is not to be understood in a wide sense, as including manufacture. It cannot be said that the business of a film producer which is that of manufacture of films or that of distribution of films is that of buying and selling within the meaning of the word 'trade', Attar Hussain v. Cine worker
Cine worker, means an individual--(i) who is employed, directly or through any contractor or other person, in or in connection with the production of a feature film to work as an artiste (including actor, musician or dancer) or to do any work, skilled, unskilled, manual, supervisory technical, artistic or otherwise; and(ii) whose remuneration with respect to such employment in or in connection with the production of such feature film does not exceed, where such remuneration is by way of monthly wages, a sum of one thousand six hundred rupees per month, and where such remuneration is by way of a lump sum, a sum of fifteen thousand rupees. Fine arts. As to copyright in works of art, see the Copyright Act, 1911 (1 & 2 Geo. 5, c. 46). 'Artistic work' is defined by the Act as including 'works of painting, drawing, sculpture and artistic craftsmanship, and architectural works of art and engravings and photographs (s. 35). 'Work of sculpture' includes casts and models (ib.). 'Architectural work of art' is defined by the Act as 'any building or structure having an artistic character or design in respect of such character or design, or any model for such building or structure, provided that the protection afforded by the Act shall be confined to the artistic character and design and shall not extend to processes or methods of construction'; 'engravings' include 'etchings, lithographs, wood-cuts, prints, and other similar works, not being photographs'; and 'photograph' includes photolithograph and any work produced by any process analogous to photography (ib.).
