Impertinence. Not pertinent to the cause of action or to the issues raised in an action. By R.S.C. 1883, Ord. XIX., r. 27, any unnecessary pleading may be struck out by order of the court or a judge, see Millington v. Loring, (1880) 6 QBD 190; Smurthwaite v. Hannay, 1894 AC at p. 495.
