Electoral roll, The electoral roll referred to in s. 62(1) of the Representation of the People Act, 1951 must be understood to be the electoral roll that was in force on the last day for making the nominations for the election, Baidyanath Panjiar v. Sitaram Mahto, (1969) 2 SCC 447: AIR 1970 SC 314: (1970) 1 SCR 839. For being eligible to be included in electoral register, one has to be: (1) a resident in that Constituency, (2) should not be subject to any legal incapacity, (3) has to be either a Commonwealth citizen or a citizen of the Republic of Ireland, (4) has to be of 18 years of age or above on the date of poll, Parliamentary Practice Erskine May, 22nd Edn., 1997, p. 26. In U.K., it is known as electoral Register. The Representation of People Act, 1983 provides for the presentation of Registers of Parliamentary electors once a year and all persons who claim to vote must be registered before election, Parliamentary Practice, Erskine May, 22nd Edn., 1997, p. 28. Is known as 'voters' list in common parlance is the basic document on which the whole electoral process is founded, Election Law Practice & Procedure, V.S. Verma Devi, p. 249. In India the electoral roll is prepared for every Assembly Constituency under the Superintendence, direction and control of the Election Commission, by Electoral Registration Officer of each Constituency, Law of Elections, P.D.T. Achary, 2004, p. 7. Of every Parliamentary Constituency consists of the rolls of all Assembly Constituencies. No separate roll is prepared for any Parliamentary Constituency except for those in the State of J&K and the Union Territories not having a legislature, Law of Elections, P.D.T. Achary, 2004, p. 7. Is revised before each general election as well as before each bye-election, Law of Elections, P.D.T. Achary, 2004, p. 9. Any person who is citizen of India and is not less than 18 years of age and is ordinarily resident in the constituency concerned is entitled to be registered in the electoral role. A person is disqualified for the registration in the electoral roll if he is not a citizen of India or is of unsound mind or is disqualified under the law dealing with corrupt practices and other offences relating to elections, Law of Elections, P.D.T.
