Deceptive resemblance, there will be deceptive resemblance of a Trade Mark if a trade mark is likely to deceive or cause confusion by its resemblance to another already on the Register of Trade Marks if it is likely to do so in the course of its legitimate use in market where the two marks are assumed to be in use, Amritdhara Pharmacy v.
