Definition :

Confiscation, the condemnation and adjudication of property to the public treasury, as of goods seized under the Customs Acts. See FORFEITURE.

Means once a confiscation proceeding is initiated, the said power cannot be exercised by the Magistrate, State of West Bengal v. Sujit Kumar Rana, (2004) 4 SCC 129.
