Legal definition for Indian law research
Definition
Arrogatio, a form of adoption in Civil Law. It could not be effected by a mere private juristic act like adoptio, but only by a decree of the comitia curiata or later by imperial rescript. Arrogatio was the form of adopting a paterfamilias or homo sui juris, and effected like the adoptio capitis deminutio minima of the arrogtus. As a rule there could be no arrogatio of an impubes or a woman, but on certain conditions arrogatio of an impubes was permitted, and since it could be effected by imperial rescript, women also might be arrogated
