Definition :

Appropriate government, means in relation to public authority which is established, constituted, owned, controlled or substantially financed by funds provided directly or indirectly--

(i) by the Central Government or the Union Territory administration, the Central Government, (ii) by the State Government, the State Government [Right to Information Act, 2005 (22 of 2005), s. 2(a)]

The Appropriate Government means, in relation to fees or stamp relating to documents presented or to be presented before any officer serving under the Central Government, that Government, and in relation to any other fees or stamps, the State Government. [Court-Fees Act, 1870 (7 of 1870), s. 1A]

Means as respects any matter--(i) enumerated in List II of the Seventh Schedule to the Constitution. (ii) relating to any State law enacted under List III of the Seventh Schedule to the Constitution. [Information Technology Act, 2000 (21 of 2000), s. 2 (1) (e)]

Means in relation to any major port the Central Government, and, in relation to any other port, the State Government. [Dock Workers (Safety, Health and Welfare) Act, 1986 (54 of 1986), s. 2 (a)]

Means in relation to any works or electric installations belonging to, or under the control of, the Central Government or in relation to any mines oilfields, railways, aerodromes, telegraphs, broadcasting stations and any works of defence, the Central Government, and in any other case, the State Government. [Indian Electricity Act, 1910 (9 of 1910), s. 2 (a)]

Means--(i) in relation to an establishment in respect of which the appropriate Government under the Industrial Disputes Act, 1947, is the Central Government, the Central Government. (ii) in relation to any other establishment, the Government of the State in which that other establishment is situated. [The Contract Labour (Regulation and Abolition) Act, 1970 (37 of 1970), s. 2 (1)]

Means--(i) in relation to an establishment in respect of which the appropriate Government under the Industrial Disputes Act, 1947 is the Central Government, the Central Government; (ii) in relation to any other establishment, the Government of the State in which that other establishment is situate. [Payment of Bonus Act, 1965 (13 of 1985), s. 2 (5) (i) (ii)]

Means--(i) in relation to the Central Administrative Tribunal or a Joint Administrative Tribunal, the Central Government; (ii) in relation to a State Administrative Tribunal, the State Government. [Administrative Tribunals Act, 1985 (13 of 1985), s. 3 (d) (i) (ii)]

Means--(i) in relation to the Central Government or any establishment wholly or substantially financed by that Government, or a Cantonment Board constituted under the Cantonment Act, 1924, the Central Government. (ii) in relation to a State Government or any establishment wholly or substantially financed by that Government or any local authority, other than a Cantonment Board, the State Government. (iii) in respect of the Central Co-ordination Committee and the Central Executive Committee, the Central Government. (iv) in respect of the State Co-ordination Committee and the State Executive Committee, the State Government. Means--(i) the Central Government, in relation to a Commission appointed by it to make an inquiry into any matter relatable to any of the entries enumerated in List I or List II or List III in the Seventh Schedule to the Constitution; and (ii) the State Government, in relation to a Commission appointed by it to make an inquiry into any matter relatable to any of the entries enumerated in List II or List III in the Seventh Schedule to the Constitution: Provided that in relation to the State of Jammu and Kashmir, these clauses shall have effect subject to the modification that-(a) in sub-clause (i) thereof, or the words and figures 'List I or List II or List III in the Seventh Schedule to the Constitution', the words and figures 'List I or List III in the Seventh Schedule to the Constitution as applicable to the State of Jammu and Kashmir' shall be substituted. (b) in sub-clause (ii) thereof, for the words and figures 'List II or List III in the Seventh Schedule to the Constitution', the words and figures 'List III in the Seventh Schedule to the Constitution as applicable to the State of Jammu and Kashmir' shall be substituted. Means--(i) in relation to an establishment belonging to, or under the control of, the Central Government or in relation to an establishment connected with a railway company, a major port, a mine or an oilfield or a controlled industry or in relation to an establishment having departments or branches in more than one State, the Central Government; and (ii) in relation to any other establishment, the State Government. [Employees' Provident Funds and Miscellaneous Provisions Act, 1952 (19 of 1952), s. 2(a)]

Means, as respects a detention order made by the Central Government or a person detained under such order, the Central Government, and as respects a detention order made by a State Government or by an officer subordinate to a State Government or as respects a person detained under such order, the State Government. [National Security Act, 1980 (65 of 1980), s. 2 (a)]

Means, in relation to an establishment being a mine or an establishment wherein persons are employed for the exhibition of equestrian, acrobatic and other performances the Central Government and in relation to any other establishment, the State Government. [Maternity Benefit Act, 1961 (53 of 1961), s. 3 (a)]

Means, in relation to an establishment under the control of the Central Government or a railway administration or a major port or a mine or oilfield, the Central Government, and in all other cases, the State Government. [Child Labour (Prohibition and Regulation) Act, 1986 (61 of 1986), s. 2 (i)]

The expression means in relation to acquisition of land for the purposes of the Union, the Central Government, and, in relation to acquisition of land for any other purposes, the State Government. [Land Acquisition Act, 1894 (1 of 1894), s. 3 (ee)]

The appropriate Government is the Government of the State of Conviction and not the Government of the State where the offence was committed, Hanuman Dass v. Vinay Kumar, AIR 1982 SC 1052 (1055). [Criminal Procedure Code (2 of 1974), ss. 385 and 432 (7)]

Appropriate Government means, in relation to railways, air transport services, mines and oilfields, the Central Government and, in relation to all other cases, the State Government [Payment of Wages Act, 1936 (4 of 1936), s. 2(i)]
