Agreed. This word in a deed creates a covenant. As to the persons respectively bound by a clause beginning 'It is hereby agreed,' see Dawes v. Tredwell, (1881) 18 Ch D 359. By the (English) Real Property Act, 1845, as reproduced and extended by (English) L. P. Act, 1925, s. 56, a person may take an immediate interest or the benefit of any covenant or agreement over land or other property although not named as a party to the Agreement. See COVENANT.
