Legal definition for Indian law research
Definition
Survivorship, the living or one of two or more persons after the death of the other or others. See COMMORIENTES; JOINT TENANCY. In questions of construction of wills the difficulty generally arises in regard to the persons or class of or from whom the survivor is to be ascertained and whether the word has a natural or stipital meaning (see, e.g., Gilmour v. MacPhillamy, 1930 AC 712).
