Definition :
Person interested, includes a person engaged in, or in promoting, research in the same field as that to which the invention relates. [Patents Act, 1970 (39 of 1970), s. 2(t)]
The definition of the 'person interested' must be liberally construed so as to include a body, local authority, or a company for whose benefit the land is acquired and who is bound under an agreement to pay the compensation, Himalaya Tiles and Merbles (P) Ltd. v. Francis Victor Countinho, AIR 1980 SC 1118 (1120): (1980) 3 SCC 233: (1980) 3 SCR 235. [Land Acquisition Act, 1844, s. 18]
The expression 'person interested' included all persons claiming an interest in compensation to be made on account of the acquisition of land under this Act; and a person shall be deemed to be interested in land if he is interested in an easement affecting the land, General Government Servants Cooperative Housing Society Ltd. v. Wahaz Uddin, AIR 1981 SC 866 (867, 868): (1981) 2 SCC 352: (1981) 3 SCR 46.
A person claiming interest in the compensation to
be awarded is a 'person interested', Karanpura Development Company v. Union of India, (1988) Supp SCC 488: AIR 1988 SC 1478. [Coal-Bearing Areas (Acquisition and Development) Act, 1957, s. 2 (d)]
The expression includes all persons claiming an interest in compensation to be made on account of the acquisition of land under this Act; and a person shall be deemed to be interested in land if he is interested in an easement affecting the land. [Land Acquisition Act, 1894 (10 of 1894), s. 3 (b)]
Person interested, is given an inclusive definition which should be liberally construed to embrace all persons who may directly or indirectly be interested either in the title of the land or in quantum of compensation, Gurmit Kaur v. State of Punjab, (1989) Punj LJ 704 (705) (P&H).
Means it is not necessary that in order to be a person interested he or she must be related to the minor. Whether the particular person is interested or not has to be seen in the context of the nature of proceedings and the consequences which the order in such proceedings might produce, Chagan Lal v. Astor Quisth, AIR 1972 AP 49: (1971) 2 Andh WR 347.
Means the beneficiary i.e. local, authority or company, a co-operative society registered under the relevant state law, or statutory authority is a person interested to determine just and proper compensation for the acquired land and is an aggrieved person, Neyvely Lignite Corporation Ltd. v. Spl. Tahsildar (Land Acquisition), Neyvely, AIR 1995 SC 1004: AIR 1995 SCW 995: (1995) 1 SCC 221; General Manager KSRTC v. Jagadguru Mallikarajuna, (1980) 2 Kant LT 306.
Means the government is not a 'person interested', Collector of Bombay v. Nusserwanji Rattanji Mistri, AIR SC 298. [Land Acquisition Act, 1894, s. 3(b)]
Means the person who claims interests in the lands by virtue of their purchase are person interested, Ramahari Maharana v. Land Acquisition Officer, AIR Ori 198: (1969) 35 Cut LT 358.
