Persistent default, means contumacious perseverance despite opposition or remonstrance, yet it cannot be said that in the absence of warning or opposition, persistent default cannot be established, State of Madras v. Tirunelveli Municipal Council, (1967) ILR 1 Mad 493: (1967) 1 Mad LJ 47.
