Definition :
Mesne profit, of property means those profits which the person in wrongful possession of such property actually received or might with ordinary diligence have received therefrom, together with interest on such profits, but shall not include profits due to improvements made by the person in wrongful possession. [Code of Civil Procedure, 1908 (5 of 1908), s. 2 (12)]
As defined in s. 2(12) of the Code of Civil Procedure, 1908 are profits which the person in wrongful possession of property actually received or might with ordinary diligence have received therefrom, together with interest on such profits, but do not include profits due to improvements made by the person in wrongful possession. The normal measure of mesne profits is the value of the user of land to the person in wrongful possession, Fateh Chand v. Balkishan Dass, AIR 1963 SC 1405 (1413): (1964) 1 SCR 515.
