This appeal has been directed against the judgment and order dated 30-11-2006 passed by the learned Sessions Judge, East and North at Gangtok in S.T. Case No. 3 of 2004 whereby the appellant was found guilty of commission of an offence punishable under Section 3 of the Official Secrets Act, 1923 (hereinafter referred to as 'the Act') under which he was convicted and sentenced to undergo simple imprisonment for a period of ten years.3.
