Dwivedi, J.1. All these appeals now raise a common question of law and are being decided by a common judgment.2. All the appellants were operators of State carriages in the State of Rajasthan. They held regular permits for various routes in the State.3. The State has a Road Transport Corporation. It is called the Raj. State Road Transport Corporation. It was constituted on October 1, 1964 under the Road Transport Corporation Act, 1950. It has a General Manager.4. Section 19(2)(c) of the aforesaid Act empowers the Corporation to acquire routes for plying buses and to exclude private operators therefrom. In 1956 Parliament inserted Chapter IV A in the Motor Vehicles Act for acquiring routes. Section 68 is to be found in that Chapter. It enables the State Govt. to make rules to carry into effect the provisions of the Chapter. The State of Rajasthan has made certain rules under this section. The above appeals arise out of three petitions filed under Article 226 of the Constitution of India bearing Writ Petition Nos. 1367, 1389 and 1448 of 1973 on the file of the High Court of Madras. Road Transport Department, had petitioned in the High Court under Article 226 against the appellant and the State of Mysore and asked it to quash an order of his dismissal, passed on 25.1.1961, in disciplinary proceedings taken against him at a time when he was a servant of the Mysore Govt. Road Transport Department. The Government Department was abolished on 1.8.1961. But, before this event happened, the Mysore Govt. had sent notices to its employees on 23.6.61. proposing to transfer all those persons who were actually in its service on the date of issue of these notices and had accepted offers of appointment as employees of the corporation. Bachawat, J.1. The respondent was a class III employee in the statistical department of the Mysore State Road Transport Corporation. In October 1961, he was temporarily promoted to act as statistical Superintendent at Hassan. On July 21, 1964, the General Manager of the Corporation issued a notice inviting applications for appointments to class II junior posts of (a) assistant/divisional statisticians and (b) labour welfare officers on a pay of Rs. 220 per month in the pay scale or Rs. 220 - 15 - 400 - EB - 20 - 500 plus the usual dearness and other allowances admissible under the Rules. On August 11 1964, the respondent filed a writ petition in the High Court at Mysore claiming that the Corporation had no power to issue the notice and praying for an order quashing it. The posts of Assistant Traffic Manager (for short "ATM) and Assistant Mechanical Engineer (for short "AME) are Class-I Junior Scale Officers posts. It is the case of the appellants that for several years, due to ban on recruitment, promotions were made from lower feeder posts even in excess of the ratio of 1:1 under A.P. State Road Transport Corporation Employees (Recruitment) Regulations, 1966 (hereinafter referred to as "the recruitment regulations).
