Petitioners who were employed in the Canteen established by The Cochin Port Trust filed this petition for directing the respondents, the Cochin Port Trust to grant all benefits to the petitioners as regular staff of the Port Trust including Scale of Pay and other service benefits and for quashing Ext. P7 issued by the Port Trust on 24.3.2000 and also for other reliefs.2. It was alleged that the petitioners were the employees of the respondent-Cochin Port Trust and were working in the Canteen from 8 to 13 years continuously, that the above canteen was providing services to the workers under the Cochin Port Trust and was a statutory canteen established under Section 46 of the Factories Act. 1. The issue in these writ petitions concerns the legality of an appointment made by the President of a Society. The appointment is said to have been ratified subsequently by the managing committee. Acting on the complaints of certain persons, the Assistant Registrar interdicted the appointment; the Society implemented his directive. But the employee was not heard before her termination. Thus, the Court is called upon to decide on the propriety of the procedure adopted by the Assistant Registrar and the Society in removing the employee. 2. The brief facts of the case are that the complainant availed a Cash Credit Loan from the 1st opposite party for an amount of Rs.7,00,000/- under Loan No.CC.98 mortgaging his property by himself and his son. The rate of interest was @ 16% at the time of passing the loan and thereafter the interest was reduced in view of the order of the Reserve Bank of India. The complainant remitted the loan amount in February, 2000 by remitting Rs.35,000/- till November, 2009. The balance amount as on 12/08/2009 was Rs.29,863/-. Thereafter the complainant remitted Rs.29,000/- on 12/11/2009. The complainant submitted an application for return of the documents to the 2nd respondent on 31/03/2010 against which an amount of Rs.1000/- was remitted.
