JUSTICE SHRI. K.R. UDAYABHANU: PRESIDENT The appellant is the complainant in O.P. 216/99 in the file of CDRF, Kollam. The complaint stands dismissed. 2. It is the case of the complainant that while serving in the Army on 15.8.96 he felt belly pain and started vomiting. The military doctor on examination and on the basis of U.S.G. Scan findings found that he is having stones in the Gall bladder and advised a minor surgery. He reached home and got admitted at the opposite party hospital on 30.9.96. He was told by the second opposite party doctor that he will have to undergo an immediate laparoscopic operation and that it is a minor procedure and can go home after 3 days. He under went the surgery done by the second opposite party assisted by the 3rd opposite party doctors. SYNOPSIS On 23-6-2010 a Division Bench of the Kerala High Court comprising of Justice C.N. Ramachandran Nair and Justice P.S. Gopinathan while disposing of a Writ Petition filed in public interest, banned the holding of meetings and rallies on public roads and road margins thereby ensuring accident-free and uninterrupted traffic along such roads. On 26-6-2010 in a meeting organized in Kannur town in protest against the hike of fuel prices, the respondent M.V. Jayarajan, a non practicing Advocate ill-informed in law and a politician belonging to the C.P.I. (Marxist) Party, made a public speech. The speech was widely covered by the print and visual media. This appeal filed under Section 5 of the Kerala High Court Act, 1958 was disposed of by a Division Bench on 25-3-2010 as “closed” consequent on the matter having been settled before the Lok Adalat organized by the High Court Legal Services Committee on 4-3-2010. But then the Registry raised an objection that the appellant had paid only 1/3 of the court fee at the time of filing the appeal and the balance court fee was not paid. Thereupon the case was posted for hearing on the above question regarding the balance court fee payable. 2. We heard Advocate Sri. P.C. Chacko, the learned counsel appearing for the appellant and Advocates M/s. Jikku Jacob and Roy Thomas, the learned Government Pleaders who represented the State. 3.
