rekha mittal, j. 1.the petitioner has invoked articles 226/227 of the constitution of india for issuance of writ of certiorari quashing annexure p-6 dated 29.4.2014 and direction to allot plot to the petitioner at the rate of rs. 5,262/- per square meter as per advertisement dated 12.2.2004 (annexure p-2). 2. some of the facts which require to be noted are that 05 acres of land belonging to the petitioner was acquired in the year 1993 for development of sectors 38 to 41 and 47, gurgaon. in the year 2004, respondents invited applications from the oustees for allotment of plots. the petitioner submitted application (annexure p-1) for allotment of 01 kanal plot, deposited an amount of rs. 2,21,004/- as earnest money and was informed vide memo (annexure p-3) that he was found eligible for allotment of residential plot measuring 01 kanal in sector 47, gurgaon under oustees policy. however, the petitioner was not allotted any plot and he filed cwp no. 1025 of 2013, decided on 27.8.2013 wherein the respondents were directed to allot 01 kanal plot to the petitioner either in sector-38 or sector-39, gurgaon. in terms of order passed by this court, the impugned allotment letter (annexure p-6) was issued and the petitioner was allotted plot no. 35 (01 kanal), sector-38, gurgaon on free hold basis at the rate of rs. 24,400/- per square meter making tentative total price to the tune of rs. 1,02,48,000/-. 3. counsel for the petitioner contends that the petitioner submitted application in .....

t.p.s. mann, j. 1.as both the aforementioned appeals are against the judgment and order dated 23.12.2009 passed by the additional sessions judge (fast track court), faridabad, they are being disposed of by a common judgment. 2. the appellants, four in all, were tried for committing the offence punishable under section 323 read with section 34 ipc for voluntarily causing hurt to pw manoj in furtherance of their common intention. they were also tried for the offence punishable under section 302 read with section 34 ipc for committing the murder of om parkash in furtherance of their common intention. vide impugned judgment and order, the trial court convicted and sentenced them as follows:- (i)under section 302 read with section 34 ipcrigorous imprisonment for life and to pay a fine of rs. 50,000/- each and in default of payment of fine, to further undergo simple imprisonment for six months and(ii)under section 323 read with section 34 ipcrigorous imprisonment for one year and to pay a fine of rs. 1,000/- each and in default of payment of fine, to further undergo simple imprisonment for one month. 3. both the sentences were ordered to run concurrently. the period already undergone by the appellants in custody during trial was ordered to be adjusted towards period of imprisonment. out of the amount of fine, if recovered, a sum of rs. 1,00,000/- was ordered to be paid to the legal heirs of deceased-om parkash and a sum of rs. 10,000/- to injured manoj, as compensation. 4. the case .....

1. as identical questions of law and facts are involved, therefore, i propose to dispose of the indicated petitions for leave to appeal, arising out of the similar impugned judgments of acquittal of the same date between the same parties, vide this common order to avoid the repetition. however, the conspectus of the facts, which needs a necessary mention for deciding the core controversy, involved in the present petitions, has been extracted from (1) crm no.a-1828-ma of 2014 titled as "t.d. gandhi ito v. sudesh sharma" for ready reference in this context. 2. the epitome of the facts and evidence, unfolded during the course of trial, culminating in the commencement, relevant for disposal of the instant petitions for leave to appeal and emanating from the record, is that sudesh sharma, advocate respondent-accused was practicing on income tax side. the main assessee ashok kumar sharma, railway contractor (for brevity "the main assessee") had engaged him for the purpose of submission of his income tax returns for the assessment year 1988-89, supplied him the requisite documents, including tds certificates in this regard. consequently, the respondent had filled the income tax return on behalf of main assessee and claimed a refund of rs.3497/- on the basis of tds certificates purported to have been issued by the senior divisional accounts officer, northern railway, new delhi. the complainant-income tax officer (for short "ito") claimed that in the wake of verification, the tds .....
