(Prayer: This criminal petition is filed under Sections 482 and 483 of the Code of Criminal Procedure, praying to issue appropriate directions to the respondents and to pass appropriate orders pursuant to the Reports- I,II,III and IV registered as Criminal Petition under Sections 482 and 483 of Cr. P C.) 1. In Crl. A. No.90/2010 c/w Crl. A Nos.16/2010 and 169/2010, one of the appellants (namely appellant No.7/prisoner) was un-represented. Hence, we issued a Body Warrant to produce him before us. But, the Warrant was returned unexecuted with a report that he was released on parole, but did not return to Jail since two years. Therefore, we directed the State to file report as to in how many cases prisoners, who were released on parole, did not return to Jail and the action taken in that regard. ORDER1. Since common question of law is involved in these petitions, they are clubbed together and a common order is passed.2. The points for consideration in both the petitions are :-1. Whether Police can take steps of taking measurements or photographs of unconvicted persons in the absence of any sanction from the competent authority ? 2. Whether prescription mentioned in the Police Manual can be said has force of law or otherwise ? 3. In this petition under Articles 226 and 227 of the Constitution, the petitioner has sought for quashing the Government Order dated 12-11-1984 bearing No. HD 87 PRR 84, produced as Annexure-E. He has also sought for issue of a writ in the nature of mandamus or any other appropriate writ or order directing the respondents to release him prematurely.2. 1) The petitioner along with four other accused was convicted on 18-8-1978 for the offences punishable under Sections 143, 148, 307 read with Section 149; and Section 324 read with Section 149 of the Indian Penal Code, in Sessions Case No. 12 of 1977 on the file of the Principal District and Sessions Judge, Bangalore, and was sentenced to undergo rigorous imprisonment for a period of 3 months, one year, 5 years and one year respectively on each of the aforesaid counts. ORDERS.R. Bannurmath, J.1. Heard the learned Counsel for the petitioner and Smt. Geetha Menon, learned Addl. Govt. Advocate, who has taken notice for respondents No. 1 and 2.2. The case of the petitioner in this writ petition is that the brother of the petitioner who was arrested, tried and convicted in S.C. No. 130/98 for the offence punishable under the provisions of N.D.P.S. Act. It is not much in dispute that the Spl. Judge has found him guilty of the offence alleged and sentenced him to undergo R.I. for 10 years with fine of Rs. One lakh carrying default sentence. The conviction passed by the Spl. Judge has been affirmed by this Court in Criminal Appeal No. 744/2005. The grievance of the petitioner (brother of the detenu-Accused No. 1) is that, his brother/A-1 has completed the sentence of imprisonment of 10 years and has also paid the fine and as such, was entitled to be released as having completed the sentence on 9/10/2008.3.
