..... it is also argued that the identification was done by the witnesses after seeing the photographs and tutoring of the police before going to identification parade and the photographs were also published in the news papers which were admitted by the witnesses in the cross examination and therefore, the said identification of the accused a1 to a4 in the two test identification parades held by p.w.37 cannot even be taken as a piece of evidence. ..... he would further submit in his argument that the witnesses examined by the prosecution in respect of the 1st incident had identified the accused before the magistrate because they had seen the news papers in which the photographs and news items were published and therefore, the identification of a1, a4 and a5 made by the prosecution witnesses before t.i. ..... 2 by the defence that he had seen the photographs published in the paper and refreshed his memory as to the identity of the accused and thereafter, he identified the accused in the identification parade. ..... 2 to the effect that the news have come in papers before 10 days and the facts have also come in the papers will not in any way mean that he had seen the photographs of the accused and got himself refreshing his memory. ..... on a careful perusal of their evidence, they did not admit that they have seen the photographs of the accused prior to the test identification parade either shown by police or from the news papers and identified the accused. .....

aca adityan) the applicant in this application, has filed w.p.no.1949 of 2001 before the honourable high court of andhra pradesh at hyderabad, which has subsequently been transferred to this tribunal, after the formation of armed forces tribunal under armed forces tribunal act 2007 and renumbered as t.a.no.55 of 2009. 2. the affidavit to the petition filed by the petitioner for the relief of pension reads as follows:- 2(a)the petitioner joined indian army in the year 1964 as an emergency commissioned officer and he was released from indian army in june 1969 after completion of 5 years of service. thereafter, the petitioner served in the dg (s) establishment 22 (cabinet secretariat) emergency affairs cell ii from july 1969 to january 1971. subsequently, he joined border security force in january 1971 and served as assistant commandant till his release in august 1974. thereafter in august 1977, the petitioner joined territorial army and was released from service in april 1992. the petitioner has put in total reckonable service of 17 years and 274 days in the central government. all the efforts made by the petitioner for grant of pension ended in futile. the respondents have rejected the request of the petitioner on the ground that he has not put in the required minimum service of 20 years. 2(b) the government of india issued proceedings dated 03.02.1998 for implementing the recommendations of the v pay commission regarding interim benefits for armed forces officers and other .....
