..... of the academic council to award punishment to any student of the university on any charge of indiscipline which power vests only in the academic council.it was further submitted that since under the banaras hindu university act by its section 11 it is the academic council which is the supreme authority in charge of the discipline of students and by section 12 it is the standing committee which can only exercise such powers and such duties as may be vested by the statute, any delegation of power to perform any function in respect of awarding punishment for breach of discipline ..... in all these cases the officers conducting the enquiry shall take such disciplinary action as may be within their power, and shall send a copy of their report to the dean of students for entry in the conduct book. ..... a fortiori it is the standing committee which is to afford an opportunity to the student proceeded against to explain his conduct and then to arrive at its conclusion for punishing him it may be that it is open to the standing committee to have a detailed enquiry made through a smaller body authorised by it or through any other responsible officer, i do not express any final opinion on that. .....

..... section 5 of the banaras hindu university act provides that the president of india shall be visitor of the university. ..... clause (1) of article 361 of the constitution of india provides that the president shall not be answerable to any court for the exercise and performance of the powers and duties of his office or for any act done or purporting to be done by him in the exercise and performance of those powers and duties. ..... the president has been made visitor of the university by virtue of his office and not in his personal capacity and thus, in my view, the personal immunity to the president for official acts provided under clause (1) of article 361 of the constitution is available to him in respect of his functions and duties as visitor of the university, because he has been made visitor by virtue of his office. 7. ..... article 361(1) of the constitution gives complete immunity to the president and governors of states from any proceeding of the court in the exercise and performance of their powers and duties of his officeincluding any duty or function which are incidental to the exercise of his power and performance of his duties. ..... the protection given under this provision not only extends to his official acts and omissions but also to those acts and omissions which are incidental to the exercise of powers and performance of his duties. ..... therefore, no court can compel the president to exercise any power or to perform any duty, nor he is amenable to the writ or direction issued by any court .....

..... on behalf of sri anant prasad gupta, it is further contended that the writ petitions filed by raghuvansh pandey against the order of vice-chancellor, sampumanand sanskrit university and vice-chancellor, banaras hindu university are liable to be dismissed on the ground of availability of alternative remedy under the provisions of section 68 of the state universities act and under the provisions of section 5(7) of the banaras hindu university act, 1850 respectively. ..... sri raghuvansh pandey, however, claims that the term of the elected committee of management is 5 years and therefore, the assistant registrar rightly directed the elected office bearers to hold fresh elections vide order dated 11.7.2003. ..... nor the elections set up by sri anant prasad gupta can stand the test of scrutiny by this court and it is in the interest of justice that the fresh elections of the office bearers of the society as well as the committee of management may be directed to be held by the registrar, firms, societies and chits, lucknow within 3 months from the date a certified copy of this order is produced before the registrar by any of the parties in exercise of powers under section 25 (2) of the societies registration act. 24. .....
